Section 717B.1, Code 2011, is amended by 3 adding the following new subsections: 4 NEW SUBSECTION . 2A. “Animal shelter” means the 5 same as defined in section 162.2. 6 NEW SUBSECTION . 3A. “Commercial establishment” 7 means the same as defined in section 162.2. 8 NEW SUBSECTION . 3B. “Department” means the 9 department of agriculture and land stewardship. 10 Sec. ___. NEW SECTION . 717B.3B Investigative and 11 enforcement proceedings. 12 The department shall qualify animal shelters to 13 provide investigatory services under this section. 14 An inspection officer designated by the qualified 15 animal shelter shall be appointed by the department as 16 an animal warden under chapter 162. The inspection 17 officer may inspect the premises of a commercial 18 establishment upon the officer’s own information or 19 upon complaint to determine if there is a violation 20 of this chapter. If the inspection officer has 21 reasonable cause to believe a violation exists and 22 remains uncorrected more than thirty days after 23 a written notice of the violation, the inspection 24 officer shall file a report with the department and 25 the county attorney in the county where the commercial 26 establishment is located. The department, the attorney 27 general, the county attorney, or the qualified animal 28 shelter may bring an action in district court to 29 restrain the commercial establishment from continuing 30 the violation. A person who fails to comply with the 31 court’s order within ten days shall be subject to a 32 civil penalty of not more than one thousand dollars. 33 Civil penalties collected under this section shall be 34 deposited in the general fund of the state. > 35 2.
