Section
1.
DISTRICT-TO-COMMUNITY
COLLEGE
PROGRAM

AND
FACILITIES
SHARING
PILOT
PROGRAM.
A
consortium
of
5
not
less
than
four
school
districts
and
a
community
6
college
may
request
approval
from
the
department
of
7
education
for
a
district-to-community
college
program
8
and
facilities
sharing
pilot
program.
The
pilot
9
program
shall
include
one
community
college
whose
10
average
annual
increase
in
joint
enrollment
over
the
11
fiscal
period
beginning
July
1,
2005,
and
ending
June
12
30,
2009,
was
between
20
and
21
percent,
and
not
less
13
than
four
contiguous
school
districts,
each
of
which
14
had
a
kindergarten
through
grade
twelve
certified
15
enrollment
for
the
2009-2010
school
year
of
not
less
16
than
six
hundred
pupils
nor
more
than
eight
hundred
17
pupils.
All
participants
in
the
consortium
shall
18
be
located
within
thirty
miles
of
two
cities
and
a
19
state
university.
Notwithstanding
the
requirement
20
that
a
school
district
have
exclusive
jurisdiction
21
in
all
matters
within
the
territory
of
the
school
22
district
under
section
274.1,
the
limitation
on
joint
23
buildings
under
section
28E.41,
and
the
expenditure
24
requirements
of
section
298.3,
the
participating
school
25
district
boards
may
enter
into
joint
contracts
for
26
the
construction
or
lease
of
buildings,
using
funds
27
accumulated
under
the
physical
plant
and
equipment
28
levy
in
section
298.2.
Buildings
constructed
or
29
leased
pursuant
to
this
section
shall
be
used
primarily
30
for
providing
community
college
courses
under
a
31
district-to-community
college
sharing
agreement
entered
32
into
by
each
of
the
school
districts
and
the
community
33
college
pursuant
to
section
257.11,
subsection
3.
