Section 8A.311, Code Supplement 2011, is 5 amended by adding the following new subsections: 6 NEW SUBSECTION . 12A. a. If the lowest responsive 7 bid received by the state or a political subdivision 8 for products or other purchases is from an out-of-state 9 business and totals less than five hundred thousand 10 dollars, and an Iowa-based business submitted a bid 11 which is within five percent or ten thousand dollars 12 of the price of the lowest bid, whichever is less, 13 the Iowa-based business which submitted the lowest 14 responsive bid shall be notified and shall be allowed 15 to match the lowest bid before a contract is awarded. 16 b. This subsection does not apply to a request 17 for bids or proposals for products or other purchases 18 associated with the following: 19 (1) Road or bridge construction or repair. 20 (2) Architectural or engineering services. 21 NEW SUBSECTION . 12B. a. A response to a request 22 for bids or proposals for products or other purchases 23 by the state or a political subdivision which totals 24 less than five hundred thousand dollars in value shall 25 contain the following information: 26 (1) The percentage of the ownership of the 27 submitting business which is held by Iowa residents. 28 (2) The percentage of the employees who will be 29 carrying out work in connection with the contract 30 who are Iowa residents. For the purposes of this 31 paragraph, “employee” includes part-time, temporary, 32 contract, and substitute employees, and includes 33 employees of any contractors or subcontractors. 34 (3) An estimate of the percentage of purchases 35 to be made by the submitting business in connection 36 with the contract that will be made from Iowa-based 37 businesses. 38 (4) The amount of property tax paid by the 39 submitting business during the most recently completed 40 fiscal year for which such a figure is available. 41 b. This subsection does not apply to a request 42 for bids or proposals for products or other purchases 43 associated with the following: 44 (1) Road or bridge construction or repair. 45 (2) Architectural or engineering services. 46 NEW SUBSECTION . 12C. Subsections 12A and 12B do 47 not apply to procurement of or for a public improvement 48 as defined in section 26.2. > 49 2.
