Section 8A.311, Code Supplement 2011, is 3 amended by adding the following new subsections: 4 NEW SUBSECTION . 12A. a. If the lowest responsive 5 bid received by the state or a political subdivision 6 for products or other purchases is from an out-of-state 7 business and totals less than five hundred thousand 8 dollars, and an Iowa-based business submitted a bid 9 which is within five percent or ten thousand dollars 10 of the price of the lowest bid, whichever is less, 11 the Iowa-based business which submitted the lowest 12 responsive bid shall be notified and shall be allowed 13 to match the lowest bid before a contract is awarded. 14 b. This subsection does not apply to a request 15 for bids or proposals for products or other purchases 16 associated with the following: 17 (1) Road or bridge construction or repair. 18 (2) Architectural or engineering services. 19 NEW SUBSECTION . 12B. a. A response to a request 20 for bids or proposals for products or other purchases 21 by the state or a political subdivision which totals 22 less than five hundred thousand dollars in value shall 23 contain the following information: 24 (1) The percentage of the ownership of the 25 submitting business which is held by Iowa residents. 26 (2) The percentage of the employees who will be 27 carrying out work in connection with the contract 28 who are Iowa residents. For the purposes of this 29 paragraph, “employee” includes part-time, temporary, 30 contract, and substitute employees, and includes 31 employees of any contractors or subcontractors. 32 (3) An estimate of the percentage of purchases 33 to be made by the submitting business in connection 34 with the contract that will be made from Iowa-based 35 businesses. 36 (4) The amount of property tax paid by the 37 submitting business during the most recently completed 38 fiscal year for which such a figure is available. 39 b. This subsection does not apply to a request 40 for bids or proposals for products or other purchases 41 associated with the following: 42 (1) Road or bridge construction or repair. 43 (2) Architectural or engineering services. 44 NEW SUBSECTION . 12C.
