ORDINANCES.

1.
During
the
period
beginning
on
the
effective
6
date
of
this
Act
and
ending
June
30,
2013,
a
local
7
authority
shall
not
adopt
a
new
ordinance
for
the
8
implementation
of
an
automated
traffic
law
enforcement
9
program.
A
local
authority
that
has
adopted
such
an
10
ordinance
prior
to
the
effective
date
of
this
Act
may
11
continue
to
use
automated
traffic
law
enforcement
12
systems
according
to
the
terms
of
the
authorizing
13
ordinance.

2.
For
purposes
of
this
section,
“automated
traffic
15
law
enforcement
system”
means
a
device
with
one
or
more
16
sensors
working
in
conjunction
with
a
traffic
control
17
signal
or
device
or
a
speed-measuring
device
to
produce
18
recorded
images
of
vehicles
being
operated
in
violation
19
of
traffic
or
speed
laws.
“Automated
traffic
law
20
enforcement
system”
does
not
include
a
device
operated
21
in
the
presence
of
a
peace
officer
or
a
device
mounted
22
on
a
school
bus
and
operated
in
the
presence
of
the
23
driver
of
the
school
bus.

Sec.
2.
AUTOMATED
TRAFFIC
LAW
ENFORCEMENT
SYSTEMS

STUDY.
26
1.
The
center
for
transportation
research
and
27
education
at
Iowa
state
university,
in
consultation
28
with
the
department
of
transportation
and
the
29
department
of
public
safety,
shall
conduct
a
30
comprehensive
study
regarding
the
use
and
effectiveness
31
of
automated
traffic
law
enforcement
systems.
The
32
elements
of
the
study
shall
include
but
are
not
limited
33
to
the
following:
34
a.
An
overview
of
the
history
of
automated
traffic
35
law
enforcement
systems
nationally
and
an
overview
of
36
the
impact
of
the
systems
on
traffic
safety
and
traffic
37
law
enforcement
in
areas
of
the
country
in
which
the
38
systems
have
been
used.
39
b.
A
compilation
and
analysis
of
available
data
40
regarding
the
use
of
automated
traffic
law
enforcement
41
systems
in
this
state
and
in
other
states
to
evaluate
42
the
effect
of
the
systems
on
accident
rates
including
43
the
number,
type,
and
severity
of
accidents
and
the
44
property
damage,
injuries,
and
fatalities
resulting
45
from
such
accidents.

c.
Information
regarding
the
manner
in
which
47
automated
traffic
law
enforcement
systems
are
regulated
48
by
various
states.

Identification
of
potential
strategies
to

the
existence
and
impact
of
automated
traffic

enforcement
programs
in
this
state.
To
the

extent
possible,
the
study
shall
evaluate
the
types
3
of
restrictions
that
might
be
imposed
on
local

authorities
by
the
state
to
limit
the
number
and
5
scope
of
such
programs
or
to
enhance
the
effectiveness
6
of
such
programs.
Possible
strategies
to
consider
7
include
requiring
legislative
approval
for
the
use
of
8
automated
traffic
law
enforcement
systems,
requiring
a
9
local
authority
to
prove
a
need
for
the
systems
as
a
10
condition
for
adopting
an
ordinance
authorizing
their
11
use,
imposing
statutory
limits
on
civil
penalties,
12
and
other
similar
strategies
for
the
regulation
of
13
automated
traffic
law
enforcement
programs.

2.
Local
authorities
that
are
using
automated
15
traffic
law
enforcement
systems
as
of
the
effective
16
date
of
this
Act
shall
provide
information
at
the
17
request
of
the
center
for
transportation
research
and
18
education
to
assist
the
center
in
conducting
the
study
19
required
under
this
section.
20
3.
The
center
for
transportation
research
and
21
education
shall
submit
a
report
of
its
study
to
the
22
general
assembly
by
January
15,
2013.

Sec.
3.
EFFECTIVE
UPON
ENACTMENT.
This
Act,
being
24
deemed
of
immediate
importance,
takes
effect
upon
25
enactment.
