Section 124.201, subsection 4, Code 4 2011, is amended to read as follows: 5 4. If any new substance is designated as a 6 controlled substance under federal law and notice of 7 the designation is given to the board, the board shall 8 similarly designate as controlled the new substance 9 under this chapter after the expiration of thirty days 10 from publication in the Federal Register of a final 11 order designating a new substance as a controlled 12 substance, unless within that thirty-day period the 13 board objects to the new designation. In that case 14 the board shall publish the reasons for objection 15 and afford all interested parties an opportunity 16 to be heard. At the conclusion of the hearing the 17 board shall announce its decision. Upon publication 18 of objection to a new substance being designated 19 as a controlled substance under this chapter by the 20 board, control under this chapter is stayed until 21 the board publishes its decision. If a substance 22 is designated as controlled by the board under this 23 paragraph subsection the control shall be temporary and 24 if within sixty days after the next regular session 25 of the general assembly convenes it has not made the 26 corresponding changes in this chapter , the temporary 27 designation of control of the substance by the board 28 shall be nullified. 29 Sec. ___. Section 124.204, subsection 4, paragraph 30 ai, Code Supplement 2011, is amended by striking the 31 paragraph and inserting in lieu thereof the following: 32 ai. (1) Salvia divinorum. 33 (2) Salvinorin A. 34 (3) HU-210. [(6aR,10aR)-9-(hydroxymethyl)-6,6- 35 dimethyl-3-(2-methyloctan-2-yl) 36 6a,7,10,10a-tetrahydrobenzo[c] chromen-1-ol)]. 37 (4) HU-211(dexanabinol, 38 (6aS,10aS)-9-(hydroxymethyl)-6,6- 39 dimethyl-3-(2-methyloctan-2-yl)-6a,7,10,10a-tetrahydrobenzo[c] 40 chromen-1-ol). 41 (5) Unless specifically exempted or unless 42 listed in another schedule, any material, compound, 43 mixture, or preparation which contains any quantity of 44 cannabimimetic agents, or which contains their salts, 45 isomers, and salts of isomers whenever the existence of 46 such salts, isomers, and salts of isomers is possible 47 within the specific chemical designation. 48 (a) The term “cannabimimetic agents” means any 49 substance that is a cannabinoid receptor type 1 (CB1 50 -1- SF2123.5186 (4) 84 jm/rj 1/ 4 #1.
receptor) agonist as demonstrated by binding studies 1 and functional assays within any of the following 2 structural classes: 3 (i) 2-(3-hydroxycyclohexyl)phenol with substitution 4 at the 5-position of the phenolic ring by alkyl or 5 alkenyl, whether or not substituted on the cyclohexyl 6 ring to any extent. 7 (ii) 3-(1-naphthoyl)indole or 8 3-(1-naphthylmethane)indole by substitution at the 9 nitrogen atom of the indole ring, whether or not 10 further substituted on the indole ring to any extent, 11 whether or not substituted on the naphthoyl or naphthyl 12 ring to any extent. 13 (iii) 3-(1-naphthoyl)pyrrole by substitution at 14 the nitrogen atom of the pyrrole ring, whether or not 15 further substituted in the pyrrole ring to any extent, 16 whether or not substituted on the naphthoyl ring to any 17 extent. 18 (iv) 1-(1-naphthylmethylene)indene by substitution 19 of the 3-position of the indene ring, whether or not 20 further substituted in the indene ring to any extent, 21 whether or not substituted on the naphthyl ring to any 22 extent. 23 (v) 3-phenylacetylindole or 3-benzoylindole by 24 substitution at the nitrogen atom of the indole ring, 25 whether or not further substituted in the indole ring 26 to any extent, whether or not substituted on the phenyl 27 ring to any extent. 28 (b) Such terms include: 29 (i) CP 47, 497 and homologues 2-[(1R, 3S)-3- 30 hydroxycyclohexyl]-5-(2-methyloctan-2-yl)phenol). 31 (ii) JWH-018 and AM678 32 1-Pentyl-3-(1-naphthoyl)indole. 33 (iii) JWH-073 1-Butyl-3-(1-naphthoyl)indole. 34 (iv) JWH-200 35 [1-[2-(4-morpholinyl)ethyl]-1H-indol-3-yl]-1- 36 naphthalenyl-methanone. 37 (v) JWH-19 1-hexyl-3-(1-naphthoyl)indole. 38 (vi) JWH-81 39 1-pentyl-3-[1-(4-methoxynaphthoyl)]indole. 40 (vii) JWH-122 41 1-pentyl-3-(4-methyl-1-naphthoyl)indole. 42 (viii) JWH-250 43 1-pentyl-3-(2-methoxynaphthoyl)indole. 44 (ix) RCS-4 and SR-19 45 1-pentyl-3-[(4methoxy)-benzoyl]indole. 46 (x) RCS-8 and SR-18 1-cyclohexylethyl-3- 47 (-2-methoxyphenylacety)indole. 48 (xi) AM2201 49 1-(5-fluoropentyl)-3-(1-naphthoyl)indole. 50 -2- SF2123.5186 (4) 84 jm/rj 2/ 4

Violation of this subsection , with respect 13 to any other controlled substances, counterfeit 14 substances, or simulated controlled substances 15 classified in section 124.204, subsection 4, paragraph 16 “ai” , section 124.204, subsection 6, paragraph “i” , 17 or classified in schedule IV or V is an aggravated 18 misdemeanor.
