Section 321.1, Code Supplement 2011, is 4 amended by adding the following new subsection: 5 NEW SUBSECTION . 95. “Automated traffic law 6 enforcement system” means a device with one or more 7 sensors working in conjunction with a traffic control 8 signal or device or a speed-measuring device to produce 9 recorded images of vehicles being operated in violation 10 of traffic or speed laws. “Automated traffic law 11 enforcement system does not include a device operated 12 in the presence of a peace officer or a device mounted 13 on a school bus and operated in the presence of the 14 driver of the school bus. 15 Sec. 2. NEW SECTION . 321.257A Automated traffic 16 law enforcement systems. 17 Notwithstanding section 321.252 or any requirement 18 of the department’s manual of traffic control devices, 19 a local authority that uses an automated traffic 20 law enforcement system in conjunction with a traffic 21 control signal shall establish the following minimum 22 periods of duration for a steady circular yellow, 23 steady yellow arrow, or flashing yellow arrow light 24 on every traffic control device within the local 25 authority’s jurisdiction: 26 1. For a traffic control device located in a speed 27 zone with a speed limit of twenty-five miles per hour 28 or less, three seconds. 29 2. For a traffic control device located in a speed 30 zone with a speed limit of more than twenty-five miles 31 per hour but not more than thirty miles per hour, three 32 and one-half seconds. 33 3. For a traffic control device located in a speed 34 zone with a speed limit of more than thirty miles per 35 hour but not more than thirty-five miles per hour, four 36 seconds. 37 4. For a traffic control device located in a speed 38 zone with a speed limit of more than thirty-five miles 39 per hour but not more than forty miles per hour, four 40 and one-half seconds. 41 5. For a traffic control device located in a speed 42 zone with a speed limit of more than forty miles per 43 hour but not more than forty-five miles per hour, five 44 seconds. 45 6. For a traffic control device located in a speed 46 zone with a speed limit of more than forty-five miles 47 per hour but not more than fifty miles per hour, five 48 and one-half seconds. 49 7. Notices mailed or citations issued 5 of violations committed prior to the effective date of 6 this Act, pursuant to a local ordinance authorizing the 7 use of an automated traffic enforcement system, shall 8 not be invalidated by the enactment of this Act and 9 shall be processed according to the provisions of the 10 law under which they were authorized. > 11 2.
