A city or county may employ the use of 8 automated traffic law enforcement systems only if the 9 city or county electorate approves the use of automated 10 traffic law enforcement systems as provided in this 11 subsection. 12 b. A city or county that proposes to use automated 13 traffic law enforcement systems shall adopt a 14 resolution containing the proposal. The board of 15 supervisors or the city council shall call a special 16 election to vote upon the proposal before the county 17 or city begins installing or using automated traffic 18 law enforcement systems. The board of supervisors or 19 the city council shall publish notice of the proposal 20 at least once, not less than four nor more than twenty 21 days before the date of the election, in one or more 22 newspapers which meet the requirements of section 23 618.14. Notice of the election shall also comply with 24 section 49.53. The election shall be held on a date 25 specified in section 39.2, subsection 4, paragraph “a” . 26 The proposal is approved if the vote in favor of the 27 proposal is equal to at least a majority of the total 28 vote cast for and against the proposal at the election. 29 If the proposal is approved by the voters, the board of 30 supervisors or city council may proceed to install and 31 use automated traffic law enforcement systems. > 32 4. EXISTING AUTOMATED TRAFFIC LAW 37 ENFORCEMENT SYSTEMS —— SUSPENSION OF USE —— VALIDITY OF 38 PRIOR NOTICES AND CITATIONS. A county or city that is 39 using an automated traffic law enforcement system prior 40 to the effective date of this Act shall discontinue 41 using the system until a proposal for the use of 42 automated traffic law enforcement systems is adopted by 43 resolution and approved by an election as provided in 44 section 321.5A, subsection 2, paragraph “b”, as enacted 45 by this Act.
