By striking page 5, line 6, through page 10, 2 line 24, and inserting: 3 < DIVISION ___ 4 TEACHER PERFORMANCE, INSTRUCTIONAL TIME, AND SCHOOL 5 TRANSPORTATION 6 Sec. ___. TEACHER PERFORMANCE, INSTRUCTIONAL TIME, 7 AND SCHOOL TRANSPORTATION —— COMMISSION REPORT. 8 1. A teacher evaluation, performance, and 9 career development commission is created to develop 10 recommendations for measures to improve teacher 11 evaluation, teacher performance, and career development 12 opportunities for teachers; changes to the minimum 13 requirements for a school day and school year; and 14 measures to equalize school transportation costs for 15 school districts, including but not limited to a review 16 of alternative transportation funding methods that can 17 provide stronger incentives for districts to operate 18 their transportation systems efficiently. With regard 19 to instructional time, the commission shall review the 20 following: 21 a. Whether the minimum length of an instructional 22 day should be extended and, if so, whether the 23 instructional day should be extended for all students 24 or for specific groups of students. 25 b. Whether the minimum number of instructional days 26 or hours in a school year should be increased and, if 27 so, whether the minimum number of days or hours in a 28 school year should be increased for all students or for 29 specific groups of students. 30 c. Whether the minimum number of instructional days 31 or hours should be rearranged to result in a shorter 32 summer break, with other days or weeks off throughout 33 the school year. 34 d. Whether the minimum school year should be 35 defined by a number of days or by a number of 36 instructional hours. 37 e. Whether there should be a uniform, statewide 38 start date for the school year that can only be 39 waived for the purpose of implementing an innovative 40 educational program. 41 f. Whether resources necessary to extend the 42 minimum length of an instructional day or the minimum 43 length of a school year are justified when compared to 44 competing education priorities. 45 2. The commission shall consist of eleven voting 46 members and five ex officio, nonvoting members 47 appointed by July 1, 2012, as follows: 48 a. The voting members shall be members of the 49 general public appointed as follows: 50 -1- HF2380.4778 (2) 84 kh/rj 1/ 3 #1.
(1) One member shall be appointed by the governor. 1 (2) Two members shall be appointed by the president 2 of the senate. 3 (3) One member shall be appointed by the minority 4 leader of the senate. 5 (4) Two members shall be appointed by the speaker 6 of the house of representatives. 7 (5) One member shall be appointed by the minority 8 leader of the house of representatives. 9 (6) One member representing public postsecondary 10 education institutions who is employed by a public 11 postsecondary education institution and who shall be 12 appointed by the governor. 13 (7) Three members representing three different 14 school districts who shall be appointed by the governor 15 as follows: 16 (a) One member shall be a teacher employed by 17 a school district or area education agency who is 18 appointed from a list of three names submitted by a 19 certified employee organization representing teachers 20 licensed under chapter 272. 21 (b) One member shall be an administrator employed 22 by a school district who is appointed from a list of 23 three names submitted by a statewide organization 24 representing administrators licensed under chapter 272. 25 (c) One member shall be a member of a board of 26 directors of a school district who is appointed by a 27 statewide organization representing schools boards. 28 b. The ex officio, nonvoting members shall be 29 appointed as follows: 30 (1) One member who is a member of the state board 31 of education appointed by the chairperson of the state 32 board of education. 33 (2) One member who is a member of the senate shall 34 be appointed by the president of the senate. 35 (3) One member who is a member of the senate shall 36 be appointed by the minority leader of the senate. 37 (4) One member who is a member of the house of 38 representatives shall be appointed by the speaker of 39 the house of representatives. 40 (5) One member who is a member of the house of 41 representatives shall be appointed by the minority 42 leader of the house of representatives. 43 c. In appointing members to the commission, proper 44 consideration shall be given to persons with experience 45 or special knowledge in one or more of the following 46 areas: education, business, technology, and finance. 47 d. The initial meeting of the commission shall 48 be convened by the member representing the public 49 postsecondary education institutions. The commission 50 -2- HF2380.4778 (2) 84 kh/rj 2/ 3
members shall elect a chairperson from among the voting 1 members of the commission. 2 e. A majority of the voting members constitutes a 3 quorum for the transaction of any official business. 4 f. Commission appointments shall be made in a 5 manner which provides geographical representation and 6 complies with sections 69.16, 69.16A, and 69.16C. 7 g. Public members of the commission are entitled 8 to receive reimbursement for actual expenses incurred 9 while engaged in the performance of official duties. 10 Legislators’ expenses shall be paid from funds 11 appropriated by section 2.12. 12 3. The department of education shall provide 13 staffing assistance to the commission. 14 4. The commission shall submit its findings and 15 recommendations in a report to the general assembly by 16 December 1, 2012. 17 Sec. ___. EFFECTIVE UPON ENACTMENT.
