House File 2361 H-8078 Amend House File 2361 as follows: 1 1. By striking everything after the enacting clause 2 and inserting: 3 < Section 1. NEW SECTION . 724.0A Intent. 4 It is the intent of the general assembly that laws 5 regarding the fundamental rights found within this 6 chapter shall be uniformly applied to all persons by 7 all political subdivisions. 8 Sec. 2. Section 724.4B, Code 2011, is amended to 9 read as follows: 10 724.4B Carrying weapons in or on school and 11 courthouse buildings and grounds —— penalty —— 12 exceptions. 13 1. a. A person who goes armed with, carries, or 14 transports a firearm of any kind, whether concealed or 15 not, in the buildings or on the grounds of a school or 16 courthouse commits a class “D” felony. 17 b. For the purposes of this section , “school” means 18 a public or nonpublic school as defined in section 19 280.2 . 20 2. Subsection 1 does not apply to the following: 21 a. A person listed under section 724.4, subsection 22 4 , paragraphs “b” through “f” or “j” . 23 b. A person who has been specifically authorized by 24 the authority in control of the school or courthouse 25 to go armed with , carry, or transport a firearm in the 26 buildings or on the school grounds of the school or 27 courthouse , including for purposes of conducting an 28 instructional program regarding firearms. 29 Sec. 3. Section 724.28, Code 2011, is amended to 30 read as follows: 31 724.28 Prohibition of regulation by political 32 subdivisions. 33 A political subdivision of the state shall not 34 enact an ordinance regulating regulate the ownership, 35 carrying, possession, legal transfer, lawful 36 transportation, registration, or licensing of firearms 37 upon real property owned or in any way controlled by 38 the political subdivision when the ownership, carrying, 39 possession, transfer, or transportation is otherwise 40 lawful under the laws of this state. An Any ordinance 41 or resolution regulating firearms in violation of this 42 section existing on or after April 5, 1990, is void and 43 unenforceable . 44 Sec. 4. CODE EDITOR DIRECTIVE. Section 724.1, Code 45 2011, shall be transferred to new section 724.1A. > 46 2.
