the
purposes
of
this
section,
unless
the

context
otherwise
requires:

a.
“Department”
means
the
same
as
defined
in

section
8.2
but
includes
the
judicial
branch.

“Department”
does
not
include
a
department
receiving
a
33
supplemental
appropriation
or
appropriation
reduction
34
pursuant
to
an
enactment
by
the
Eighty-fourth
General
35
Assembly,
2012
Session,
for
the
fiscal
year
beginning
36
July
1,
2011,
the
office
of
the
public
defender,
or
the
37
institutions
under
the
control
of
the
state
board
of
38
regents.

“Operational
expenditures”
means
office

supplies,
other
supplies,
information
technology

equipment,
postage,
printing
and
binding,
professional

and
scientific
services,
utilities,
and
communications.

“Operational
expenditures”
does
not
include

funding
for
indigent
defense,
funding

under
the
appropriation
made

the
department

the
time

shall
be
subject
to
a
limitation

on
operational
expenditures
made
by
the
department

on
or
after
the
effective
date
of
this
section
in

accordance
with
this
section.

b.
The
limitation
shall
be
equal
to
50
percent
of

the
unexpended
or
unencumbered
amount
that
a
department
6
has
budgeted
or
otherwise
designated
for
purposes
7
of
operational
expenditures
from
the
appropriations
8
made
to
the
department
from
the
general
fund
of
the
9
state
for
the
fiscal
year
beginning
July
1,
2011,
and
10
ending
June
30,
2012,
as
of
the
effective
date
of
this
11
section.
12
3.
The
appropriations
to
which
the
expenditure
13
limitations
required
by
this
section
are
attributed
14
shall
be
reduced
by
the
amount
of
the
expenditure
15
limitations.
Within
30
days
of
the
enactment
date
of
16
this
section,
the
department
of
management
shall
apply
17
such
appropriation
reductions
and
shall
submit
a
report
18
to
the
general
assembly
and
legislative
services
agency
19
itemizing
the
expenditure
and
appropriation
reductions
20
applied.
