For purposes of this section : 20 a. “Commissioner” means the labor commissioner 21 appointed pursuant to section 91.2, or the labor 22 commissioner’s designee. 23 b. “Division” means the division of labor of the 24 department of workforce development. 25 c. “Nonresident bidder” means a person or entity who 26 does not meet the definition of a resident bidder. 27 d. “Public body” means the state and any of its 28 political subdivisions, including a school district, 29 public utility, or the state board of regents. 30 a. e. “Public improvement” means public 31 improvements as defined in section 73A.1 a building or 32 other construction work to be paid for in whole or in 33 part by the use of funds of the state, its agencies, 34 and any of its political subdivisions and includes road 35 construction, reconstruction, and maintenance projects. 36 f. “Public utility” includes municipally owned 37 utilities and municipally owned waterworks. 38 b. g. “Resident bidder” means a person or entity 39 authorized to transact business in this state and 40 having a place of business for transacting business 41 within the state at which it is conducting and has 42 conducted business for at least six months three years 43 prior to the date of the first advertisement for the 44 public improvement and in the case of a corporation, 45 having at least fifty percent of its common stock 46 owned by residents of this state . If another state 47 or foreign country has a more stringent definition of 48 a resident bidder, the more stringent definition is 49 applicable as to bidders from that state or foreign 50 -9- H1702.3389 (3) 84 rh/tm 9/ 24
country. 1 h. “Resident labor force preference” means a 2 requirement in which all or a portion of a labor force 3 working on a public improvement is a resident of a 4 particular state or country. 5 2. Notwithstanding this chapter , chapter 73 , 6 chapter 309 , chapter 310 , chapter 331 , or chapter 7 384 , when a contract for a public improvement is 8 to be awarded to the lowest responsible bidder, a 9 resident bidder shall be allowed a preference as 10 against a nonresident bidder from a state or foreign 11 country which if that state or foreign country gives 12 or requires a any preference to bidders from that 13 state or foreign country , including but not limited 14 to any preference to bidders, the imposition of any 15 type of labor force preference, or any other form of 16 preferential treatment to bidders or laborers from that 17 state or foreign country . The preference is allowed 18 shall be equal to the preference given or required by 19 the state or foreign country in which the nonresident 20 bidder is a resident. In the instance of a resident 21 labor force preference, a nonresident bidder shall 22 apply the same resident labor force preference to a 23 public improvement in this state as would be required 24 in the construction of a public improvement by the 25 state or foreign country in which the nonresident 26 bidder is a resident. 27 3. This section applies to the state, its agencies, 28 and any political subdivisions of the state. 29 4. 3. If it is determined that this may cause 30 denial of federal funds which would otherwise be 31 available, or would otherwise be inconsistent with 32 requirements of any federal law or regulation , this 33 section shall be suspended, but only to the extent 34 necessary to prevent denial of the funds or to 35 eliminate the inconsistency with federal requirements. 36 4. The public body involved in a public improvement 37 shall require a nonresident bidder to specify on all 38 project bid specifications and contract documents 39 whether any preference as described in subsection 2 is 40 in effect in the nonresident bidder’s state or country 41 of domicile at the time of a bid submittal. 42 5. The commissioner and the division shall 43 administer and enforce this section, and the 44 commissioner shall adopt rules for the administration 45 and enforcement of this section as provided in section 46 91.6. 47 6. The commissioner shall have the following powers 48 and duties for the purposes of this section: 49 a. The commissioner may hold hearings and 50 -10- H1702.3389 (3) 84 rh/tm 10/ 24
investigate charges of violations of this section. 1 b. The commissioner may, consistent with due 2 process of law, enter any place of employment to 3 inspect records concerning labor force residency, to 4 question an employer or employee, and to investigate 5 such facts, conditions, or matters as are deemed 6 appropriate in determining whether any person 7 has violated the provisions of this section. The 8 commissioner shall only make such an entry in response 9 to a written complaint. 10 c. The commissioner shall develop a written 11 complaint form applicable to this section and make it 12 available in division offices and on the department of 13 workforce development’s internet site. 14 d. The commissioner may sue for injunctive relief 15 against the awarding of a contract, the undertaking of 16 a public improvement, or the continuation of a public 17 improvement in response to a violation of this section. 18 e. The commissioner may investigate and ascertain 19 the residency of a worker engaged in any public 20 improvement in this state. 21 f. The commissioner may administer oaths, take 22 or cause to be taken deposition of witnesses, and 23 require by subpoena the attendance and testimony of 24 witnesses and the production of all books, registers, 25 payrolls, and other evidence relevant to a matter under 26 investigation or hearing. 27 g. The commissioner may employ qualified personnel 28 as are necessary for the enforcement of this section. 29 Such personnel shall be employed pursuant to the merit 30 system provisions of chapter 8A, subchapter IV. 31 h. The commissioner shall require a contractor or 32 subcontractor to file, within ten days of receipt of a 33 request, any records enumerated in subsection 7. If 34 the contractor or subcontractor fails to provide the 35 requested records within ten days, the commissioner 36 may direct, within fifteen days after the end of the 37 ten-day period, that the fiscal or financial office 38 charged with the custody and disbursement of funds of 39 the public body that contracted for construction of the 40 public improvement or undertook the public improvement, 41 to immediately withhold from payment to the contractor 42 or subcontractor up to twenty-five percent of the 43 amount to be paid to the contractor or subcontractor 44 under the terms of the contract or written instrument 45 under which the public improvement is being performed. 46 The amount withheld shall be immediately released 47 upon receipt by the public body of a notice from the 48 commissioner indicating that the request for records as 49 required by this section has been satisfied. 50 -11- H1702.3389 (3) 84 rh/tm 11/ 24
7. While participating in a public improvement, 1 a nonresident bidder domiciled in a state or country 2 that has established a resident labor force preference 3 shall make and keep, for a period of not less than 4 three years, accurate records of all workers employed 5 by the contractor or subcontractor on the public 6 improvement. The records shall include each worker’s 7 name, address, telephone number when available, social 8 security number, trade classification, and the starting 9 and ending time of employment. 10 8. Any person or entity that violates the 11 provisions of this section is subject to a civil 12 penalty in an amount not to exceed one thousand dollars 13 for each violation found in a first investigation by 14 the division, not to exceed five thousand dollars 15 for each violation found in a second investigation 16 by the division, and not to exceed fifteen thousand 17 dollars for a third or subsequent violation found 18 in any subsequent investigation by the division. 19 Each violation of this section for each worker and 20 for each day the violation continues constitutes a 21 separate and distinct violation. In determining the 22 amount of the penalty, the division shall consider the 23 appropriateness of the penalty to the person or entity 24 charged, upon determination of the gravity of the 25 violations. The collection of these penalties shall 26 be enforced in a civil action brought by the attorney 27 general on behalf of the division. 28 9. A party seeking review of the division’s 29 determination pursuant to this section may file a 30 written request for an informal conference. The 31 request must be received by the division within fifteen 32 days after the date of issuance of the division’s 33 determination. During the conference, the party 34 seeking review may present written or oral information 35 and arguments as to why the division’s determination 36 should be amended or vacated. The division shall 37 consider the information and arguments presented and 38 issue a written decision advising all parties of the 39 outcome of the conference. 40 Sec. ___. Section 331.341, subsection 2, Code 2011, 41 is amended to read as follows: 42 2. The board shall give preference to Iowa products 43 and labor in accordance with chapter 73 and shall 44 comply with bid and contract requirements in chapter 45 26 . 46 Sec. ___. REPEAL. Sections 73.3 and 73.4, Code 47 2011, are repealed. 48 Sec. ___. EFFECTIVE UPON ENACTMENT. This division 49 of this Act, being deemed of immediate importance, 50 -12- H1702.3389 (3) 84 rh/tm 12/ 24
takes effect upon enactment. 1 Sec. ___. APPLICABILITY. This division of this Act 2 applies to all public improvement, public works, and 3 public road projects, and to public improvement, public 4 works, and public road contracts entered into on or 5 after the effective date of this Act. 6 DIVISION VII 7 BUSINESS DEVELOPMENT ASSISTANCE —— APPROPRIATION 8 Sec. ___. BUSINESS DEVELOPMENT ASSISTANCE —— USE OF 9 EXISTING FUNDS. 10 1. a. There is appropriated from the rebuild Iowa 11 infrastructure fund to the department of economic 12 development for the fiscal year beginning July 1, 2011, 13 and ending June 30, 2012, the following amount, or 14 so much thereof as is necessary, to be used for the 15 purposes designated: 16 For marketing and promotional activities; for 17 information technology development; for laborshed 18 studies conducted for the department by the department 19 of workforce development; for administrative purposes, 20 including salaries, support, maintenance, and 21 miscellaneous purposes; and for providing financial 22 assistance to businesses expanding or locating in the 23 state, notwithstanding section 8.57, subsection 6, 24 paragraph “c”: 25 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 15,000,000 26 b. Of the moneys appropriated pursuant to paragraph 27 “a” for purposes of marketing and promotional 28 activities, the department shall not use more than 29 $2,300,000. 30 c. Of the moneys appropriated pursuant to paragraph 31 “a” for purposes of information technology development, 32 the department shall not use more than $350,000. 33 d. Of the moneys appropriated pursuant to paragraph 34 “a” for purposes of laborshed studies conducted by the 35 department of workforce development, the department 36 shall not use more than $145,000. 37 e. Of the moneys appropriated pursuant to paragraph 38 “a” for administrative purposes, the department shall 39 not use more than 5 percent. 40 f. (1) The department may use the remainder of the 41 moneys appropriated pursuant to paragraph “a” that are 42 not expended for the purposes described in paragraphs 43 “b” through “e” to provide financial assistance to 44 businesses expanding or locating in the state. 45 (2) An award of financial assistance pursuant to 46 this paragraph “f” shall be approved by the economic 47 development board which shall review with due diligence 48 the merits of each application for assistance. 49 (3) For each award of financial assistance made 50 -13- H1702.3389 (3) 84 rh/tm 13/ 24
pursuant to this paragraph “f”, the department shall 1 enter into an agreement with the recipient of the 2 financial assistance, and each agreement shall meet 3 the requirements for financial assistance agreements 4 described in section 15G.112, subsections 1 through 3, 5 Code 2011. 6 (4) In providing financial assistance pursuant 7 to this paragraph “f”, the department shall allocate 8 the available moneys to a diverse range of projects 9 that create or retain jobs including projects that pay 10 better than average wages, projects that represent 11 early-stage business development, projects that build 12 the physical infrastructure necessary for business 13 growth and expansion, projects that enhance the 14 growth of value-added agriculture in the state, and 15 projects that involve recovery from significant natural 16 disasters. 17 (5) The department shall adopt rules for the 18 implementation of this paragraph “f”. Such rules 19 may be adopted as emergency rules under section 20 17A.4, subsection 3, and section 17A.5, subsection 21 2, paragraph “b”. Such rules shall be effective 22 immediately upon filing unless a later date is 23 specified in the rules. Any rules adopted in 24 accordance with this section shall also be published 25 as a notice of intended action as provided in section 26 17A.4. 27 (6) For purposes of this paragraph “f”, “financial 28 assistance” means assistance provided only from the 29 funds, rights, and assets legally available to the 30 department pursuant to this chapter and includes but is 31 not limited to assistance in the form of grants, loans, 32 forgivable loans, and royalty payments. 33 2. There is appropriated to the department of 34 economic development for the fiscal year beginning 35 July 1, 2011, and ending June 30, 2012, the following 36 amounts, or so much thereof as is necessary, to be used 37 for the purposes described in subsection 1: 38 a. Payments of interest, repayments of moneys 39 loaned, and recaptures of grants and loans made 40 pursuant to chapter 15G, Code 2011. 41 b. All moneys accruing to the department, including 42 payments of interest, repayments of moneys loaned, 43 royalty payments received, and recaptures of grants, 44 loans, or other forms of financial assistance provided 45 to recipients, from the department’s administration of 46 the following preexisting programs: 47 (1) The community economic betterment program 48 established pursuant to section 15.317, Code 2009. 49 (2) The entrepreneurial ventures assistance program 50 -14- H1702.3389 (3) 84 rh/tm 14/ 24
established pursuant to section 15.339, Code 2009. 1 (3) The value-added agricultural products and 2 processes financial assistance program established 3 pursuant to section 15E.111, Code 2009. 4 (4) The physical infrastructure assistance program 5 established pursuant to section 15E.175, Code 2009. 6 (5) The loan and credit guarantee program 7 established pursuant to section 15E.224, Code 2009. 8 c. The moneys transferred to the grow Iowa values 9 fund pursuant to 2009 Iowa Acts, chapter 123, section 10 9, subsections 1 and 2. 11 3. The moneys appropriated pursuant to this section 12 are not subject to section 8.33. Notwithstanding 13 section 12C.7, interest or earnings on the appropriated 14 moneys shall be credited to the department and may 15 be used in subsequent fiscal years for the purposes 16 described in subsection 1. 17 DIVISION VIII 18 MISCELLANEOUS CODE CHANGES 19 Sec. ___. Section 8.57, subsection 6, paragraph c, 20 Code 2011, is amended to read as follows: 21 c. Moneys in the fund in a fiscal year shall 22 be used as directed by the general assembly for 23 public vertical infrastructure projects. For the 24 purposes of this subsection , “vertical infrastructure” 25 includes only land acquisition and construction , ; 26 major renovation and major repair of buildings , ; all 27 appurtenant structures , ; utilities , ; site development , 28 and ; recreational trails ; and debt service payments 29 on academic revenue bonds issued in accordance with 30 chapter 262A for capital projects at board of regents 31 institutions . “Vertical infrastructure” does not 32 include routine, recurring maintenance or operational 33 expenses or leasing of a building, appurtenant 34 structure, or utility without a lease-purchase 35 agreement. 36 Sec. ___. Section 8.57, subsection 6, paragraph f, 37 Code 2011, is amended to read as follows: 38 f. There is appropriated from the rebuild Iowa 39 infrastructure fund to the secure an advanced vision 40 for education fund created in section 423F.2 , for each 41 fiscal year of the fiscal period beginning July 1, 42 2008, and ending June 30, 2010, and for each fiscal 43 year of the fiscal period beginning July 1, 2011, 44 and ending June 30, 2014, the amount of the moneys 45 in excess of the first forty-seven million dollars 46 credited to the rebuild Iowa infrastructure fund during 47 the fiscal year, not to exceed ten million dollars. 48 Sec. ___. Section 8.57A, subsection 4, Code 2011, 49 is amended to read as follows: 50 -15- H1702.3389 (3) 84 rh/tm 15/ 24
4. a. There is appropriated from the rebuild Iowa 1 infrastructure fund for the fiscal years year beginning 2 July 1, 2008, July 1, 2009, and July 1, 2011 2012 , and 3 for each fiscal year thereafter, the sum of forty-two 4 thirty-five million dollars to the environment first 5 fund, notwithstanding section 8.57, subsection 6 , 6 paragraph “c” . 7 b. There is appropriated from the rebuild Iowa 8 infrastructure fund each fiscal year for the fiscal 9 year period beginning July 1, 2010, and ending June 30, 10 2011 2012 , the sum of thirty-three million dollars to 11 the environment first fund, notwithstanding section 12 8.57, subsection 6 , paragraph “c” . 13 Sec. ___. Section 8.57C, subsection 3, paragraphs a 14 and c, Code 2011, are amended to read as follows: 15 a. There is appropriated from the general fund of 16 the state for the fiscal years year beginning July 1, 17 2006, July 1, 2007, July 1, 2011 2012 , and for each 18 subsequent fiscal year thereafter, the sum of seventeen 19 million five hundred thousand dollars to the technology 20 reinvestment fund. 21 c. There is appropriated from the rebuild Iowa 22 infrastructure fund for the fiscal year beginning 23 July 1, 2010, and ending June 30, 2011, the sum of ten 24 million dollars to the technology reinvestment fund, 25 notwithstanding section 8.57, subsection 6 , paragraph 26 “c” . 27 Sec. ___. Section 8.57C, subsection 3, Code 2011, 28 is amended by adding the following new paragraph: 29 NEW PARAGRAPH . d. There is appropriated from the 30 rebuild Iowa infrastructure fund for the fiscal year 31 beginning July 1, 2011, and ending June 30, 2012, 32 the sum of sixteen million dollars to the technology 33 reinvestment fund, notwithstanding section 8.57, 34 subsection 6, paragraph “c” . 35 Sec. ___. Section 8A.321, subsection 6, Code 2011, 36 is amended by adding the following new paragraph: 37 NEW PARAGRAPH . d. The department shall issue a 38 request for proposals for leasing privately owned 39 office space for state employees in the downtown 40 area of the city of Des Moines prior to replacing or 41 renovating publicly owned buildings or relocating 42 any state agencies to any space in publicly owned 43 buildings. The department shall locate state employees 44 in office space in the most cost-efficient manner 45 possible. In determining cost efficiency, the 46 department shall consider all costs of the publicly 47 owned space, the costs of the original acquisition 48 of the publicly owned space, the costs of tenant 49 improvements to the publicly owned space, and the 50 -16- H1702.3389 (3) 84 rh/tm 16/ 24
anticipated economic and useful life of the publicly 1 owned building space. 2 Sec. ___. Section 12.82, subsection 1, Code 2011, 3 is amended to read as follows: 4 1. A school infrastructure fund is created and 5 established as a separate and distinct fund in the 6 state treasury under the control of the department of 7 education. The Notwithstanding any other provision 8 of this chapter, the fund shall be used for purposes 9 of the school infrastructure program established in 10 section 292.2 . 11 Sec. ___. Section 12.82, Code 2011, is amended by 12 adding the following new subsection: 13 NEW SUBSECTION . 3A. Any amounts remaining in the 14 school infrastructure fund at the end of the fiscal 15 year beginning July 1, 2010, and for each fiscal year 16 thereafter, which are determined by the treasurer of 17 state to be unencumbered and unobligated and otherwise 18 unnecessary to make the payments for such fiscal year, 19 shall be transferred to the rebuild Iowa infrastructure 20 fund. 21 Sec. ___. Section 15F.204, subsection 8, paragraph 22 a, subparagraph (6), Code 2011, is amended to read as 23 follows: 24 (6) For the fiscal year beginning July 1, 2011, 25 and ending June 30, 2012, the sum of five million one 26 hundred thousand dollars. 27 Sec. ___. Section 15F.204, subsection 8, paragraph 28 b, Code 2011, is amended by striking the paragraph. 29 Sec. ___. Section 16.181A, subsection 1, Code 2011, 30 is amended to read as follows: 31 1. There is appropriated from the rebuild Iowa 32 infrastructure fund to the Iowa finance authority for 33 deposit in the housing trust fund created in section 34 16.181 , for the fiscal year beginning July 1, 2009, and 35 beginning July 1, 2011 2012 , and for each succeeding 36 fiscal year, the sum of three million dollars. 37 Sec. ___. Section 16.181A, Code 2011, is amended by 38 adding the following new subsection: 39 NEW SUBSECTION . 3. There is appropriated from the 40 rebuild Iowa infrastructure fund to the Iowa finance 41 authority for deposit in the housing trust fund created 42 in section 16.181, for the fiscal year beginning July 43 1, 2011, and ending June 30, 2012, the sum of two 44 million dollars. 45 Sec. ___. Section 16.193, subsection 2, Code 2011, 46 is amended to read as follows: 47 2. During the term of the Iowa jobs program 48 established in section 16.194 and the Iowa jobs II 49 program established in section 16.194A For the period 50 -17- H1702.3389 (3) 84 rh/tm 17/ 24
beginning July 1, 2009, and ending June 30, 2011 , two 1 hundred thousand dollars of the moneys deposited in the 2 rebuild Iowa infrastructure fund shall be allocated 3 each fiscal year to the Iowa finance authority for 4 purposes of administering the Iowa jobs program, 5 notwithstanding section 8.57, subsection 6 , paragraph 6 “c” . 7 Sec. ___. EFFECTIVE AND APPLICABILITY DATES. The 8 sections of this division amending section 12.82, 9 being deemed of immediate importance, take effect upon 10 enactment and, if approved by the governor on or after 11 July 1, 2011, shall apply retroactively to June 30, 12 2011. 13 DIVISION IX 14 CHANGES TO PRIOR APPROPRIATIONS 15 Sec. ___. 2006 Iowa Acts, chapter 1179, section 18, 16 is amended by adding the following new subsection: 17 NEW SUBSECTION . 5. Except for the allocation to 18 Des Moines area community college and notwithstanding 19 section 8.33, moneys appropriated from the endowment 20 for Iowa’s health restricted capitals fund for the 21 fiscal year beginning July 1, 2006, and ending June 30, 22 2007, in this division of this Act to the department of 23 public safety for allocation to the division of fire 24 protection that remain unencumbered or unobligated 25 at the close of the fiscal year shall not revert 26 but shall remain available for expenditure for the 27 purposes designated until the close of the fiscal year 28 beginning July 1, 2011, or until the project for which 29 the appropriation was made is completed, whichever 30 is earlier. This subsection shall apply in lieu of 31 subsection 1 of this section. 32 Sec. ___. 2007 Iowa Acts, chapter 219, section 2, 33 is amended to read as follows: 34 SEC. 2. REVERSION. 35 1. Notwithstanding Except as provided in subsection 36 2 and notwithstanding section 8.33, moneys appropriated 37 for the fiscal year beginning July 1, 2007, in this 38 division of this Act that remain unencumbered or 39 unobligated at the close of the fiscal year shall not 40 revert but shall remain available for the purposes 41 designated until the close of the fiscal year that 42 begins July 1, 2010, or until the project for which 43 the appropriation was made is completed, whichever is 44 earlier. 45 2. a. Notwithstanding section 8.33, moneys 46 appropriated in section 1, subsection 1, paragraphs 47 “a” and “f” of this division of this Act that remain 48 unencumbered or unobligated at the close of the fiscal 49 year for which they were appropriated shall not revert 50 -18- H1702.3389 (3) 84 rh/tm 18/ 24
but shall remain available for the purposes designated 1 until the close of the fiscal year that begins July 1, 2 2011, or until the project for which the appropriation 3 was made is completed, whichever is earlier. 4 b. The department of administrative services 5 is authorized to provide for the disposition and 6 relocation of structures located at 707 east locust 7 and 709 east locust, Des Moines, Iowa, in a manner as 8 deemed appropriate by the department. The disposition 9 of the structures, if possible, shall be completed in 10 a manner that reduces or eliminates the costs of the 11 state associated with the removal of the structures 12 from their current locations. Any amount received from 13 the disposition of the structures as permitted under 14 this section shall be retained by the department to pay 15 for improvement costs associated with the restoration 16 of the west capitol terrace. The department, if unable 17 to otherwise dispose of the structures, is authorized 18 to demolish the structures using other appropriate 19 funding available to the department. 20 Sec. ___. 2008 Iowa Acts, chapter 1179, section 1, 21 subsection 13, paragraph c, as amended by 2009 Iowa 22 Acts, chapter 184, section 22, is amended to read as 23 follows: 24 c. RETROACTIVE APPLICABILITY.
