It is the intent of the general assembly 5 that as a condition of receiving the appropriation 6 provided in this lettered paragraph the department of 7 corrections shall not, except as otherwise provided 8 in paragraph “c”, enter into a new contract, unless 9 the contract is a renewal of an existing contract, 10 for the expenditure of moneys in excess of $100,000 11 during the fiscal year beginning July 1, 2011, for the 12 privatization of services performed by the department 13 using state employees as of July 1, 2011, or for the 14 privatization of new services by the department without 15 prior consultation with any applicable state employee 16 organization affected by the proposed new contract and 17 prior notification of the co-chairpersons and ranking 18 members of the joint appropriations subcommittee on the 19 justice system. 20 b. It is the intent of the general assembly 21 that each lease negotiated by the department of 22 corrections with a private corporation for the purpose 23 of providing private industry employment of inmates in 24 a correctional institution shall prohibit the private 25 corporation from utilizing inmate labor for partisan 26 political purposes for any person seeking election to 27 public office in this state and that a violation of 28 this requirement shall result in a termination of the 29 lease agreement. 30 c. It is the intent of the general assembly that as 31 a condition of receiving the appropriation provided in 32 this subsection the department of corrections shall not 33 enter into a lease or contractual agreement pursuant to 34 section 904.809 with a private corporation for the use 35 of building space for the purpose of providing inmate 36 employment without providing that the terms of the 37 lease or contract establish safeguards to restrict, to 38 the greatest extent feasible, access by inmates working 39 for the private corporation to personal identifying 40 information of citizens. 41 2. b. It is the intent of the general assembly that 1 moneys appropriated in this subsection shall be used 2 solely for the purpose indicated and that the moneys 3 shall not be transferred for any other purpose. In 4 addition, it is the intent of the general assembly 5 that the department shall consult with the community 6 colleges in the areas in which the institutions 7 are located to utilize moneys appropriated in this 8 subsection to fund the high school completion, high 9 school equivalency diploma, adult literacy, and adult 10 basic education programs in a manner so as to maintain 11 these programs at the institutions. 12 c. To maximize the funding for educational 13 programs, the department shall establish guidelines 14 and procedures to prioritize the availability of 15 educational and vocational training for inmates based 16 upon the goal of facilitating an inmate’s successful 17 release from the correctional institution. 18 d. The director of the department of corrections 19 may transfer moneys from Iowa prison industries for use 20 in educational programs for inmates. 21 e. Notwithstanding section 8.33, moneys 22 appropriated in this subsection that remain unobligated 23 or unexpended at the close of the fiscal year shall not 24 revert but shall remain available to be used only for 25 the purposes designated in this subsection until the 26 close of the succeeding fiscal year. 27 3. It is the intent of the general assembly that 36 for the fiscal year addressed by this section the 37 department of corrections shall continue to operate the 38 correctional farms under the control of the department 39 at the same or greater level of participation and 40 involvement as existed as of January 1, 2011; shall not 41 enter into any rental agreement or contract concerning 42 any farmland under the control of the department that 43 is not subject to a rental agreement or contract as of 44 January 1, 2011, without prior legislative approval; 45 and shall further attempt to provide job opportunities 46 at the farms for inmates. The department shall attempt 47 to provide job opportunities at the farms for inmates 48 by encouraging labor-intensive farming or gardening 49 where appropriate; using inmates to grow produce 50 -5- S3233.3362.S (2) 84 jh 5/ 31
and meat for institutional consumption; researching 1 the possibility of instituting food canning and 2 cook-and-chill operations; and exploring opportunities 3 for organic farming and gardening, livestock ventures, 4 horticulture, and specialized crops. 5 7. The department of corrections shall solicit 6 requests for information to improve efficiencies at the 7 pharmacy under the control of the department. 8 Sec. 5. 3. Each judicial district department of 1 correctional services shall provide alternatives to 2 prison consistent with chapter 901B. The alternatives 3 to prison shall ensure public safety while providing 4 maximum rehabilitation to the offender. A judicial 5 district department of correctional services may also 6 establish a day program. 7 4. The governor’s office of drug control policy 8 or any succeeding entity of the governor’s office of 9 drug control policy shall consider federal grants made 10 to the department of corrections for the benefit of 11 each of the eight judicial district departments of 12 correctional services as local government grants, as 13 defined pursuant to federal regulations. 14 5. The department of corrections shall continue 15 to contract with a judicial district department 16 of correctional services to provide for the rental 17 of electronic monitoring equipment which shall be 18 available statewide. 19 Sec. 6. DEPARTMENT OF CORRECTIONS —— REALLOCATION 20 OF APPROPRIATIONS. Notwithstanding section 8.39, 21 within the moneys appropriated in this Act to the 22 department of corrections, the department may 23 reallocate the moneys appropriated and allocated as 24 necessary to best fulfill the needs of the correctional 25 institutions, administration of the department, and the 26 judicial district departments of correctional services. 27 However, in addition to complying with the requirements 28 of sections 904.116 and 905.8 and providing notice 29 to the legislative services agency, the department 30 of corrections shall also provide notice to the 31 department of management, prior to the effective date 32 of the revision or reallocation of an appropriation 33 made pursuant to this section. The department of 34 corrections shall not reallocate an appropriation or 35 allocation for the purpose of eliminating any program. 36 Sec. 7. INTENT —— REPORTS. 37 1. The department of corrections in cooperation 38 with townships, the Iowa cemetery associations, and 39 other nonprofit or governmental entities may use inmate 40 labor during the fiscal year beginning July 1, 2011, 41 to restore or preserve rural cemeteries and historical 42 landmarks. The department in cooperation with the 43 counties may also use inmate labor to clean up roads, 44 major water sources, and other water sources around the 45 state. 46 2. On a quarterly basis the department shall 47 provide a status report regarding private-sector 48 employment to the legislative services agency beginning 49 on July 1, 2011. The report shall include the number 50 -7- S3233.3362.S (2) 84 jh 7/ 31
of offenders employed in the private sector, the 1 combined number of hours worked by the offenders, the 2 total amount of allowances, and the distribution of 3 allowances pursuant to section 904.702, including any 4 moneys deposited in the general fund of the state. 5 Sec. 8. ELECTRONIC MONITORING REPORT. The 6 department of corrections shall submit a report on 7 electronic monitoring to the general assembly, to the 8 co-chairpersons and the ranking members of the joint 9 appropriations subcommittee on the justice system, and 10 to the legislative services agency by January 15, 2012. 11 The report shall specifically address the number of 12 persons being electronically monitored and break down 13 the number of persons being electronically monitored 14 by offense committed. The report shall also include a 15 comparison of any data from the prior fiscal year with 16 the current year. 17 Sec. 9. STATE AGENCY PURCHASES FROM PRISON 18 INDUSTRIES. 19 1. As used in this section, unless the context 20 otherwise requires, “state agency” means the government 21 of the state of Iowa, including but not limited to 22 all executive branch departments, agencies, boards, 23 bureaus, and commissions, the judicial branch, 24 the general assembly and all legislative agencies, 25 institutions within the purview of the state board of 26 regents, and any corporation whose primary function is 27 to act as an instrumentality of the state. 28 2. State agencies are hereby encouraged to purchase 29 products from Iowa state industries, as defined in 30 section 904.802, when purchases are required and the 31 products are available from Iowa state industries. 32 State agencies shall obtain bids from Iowa state 33 industries for purchases of office furniture during the 34 fiscal year beginning July 1, 2011, exceeding $5,000 35 or in accordance with applicable administrative rules 36 related to purchases for the agency. 37 Sec. 10. IOWA LAW ENFORCEMENT ACADEMY. 38 1. Iowa law enforcement academy may provide training of 1 state and local law enforcement personnel concerning 2 the recognition of and response to persons with 3 Alzheimer’s disease. 4 The Iowa law enforcement academy may temporarily 5 exceed and draw more than the amount appropriated in 6 this subsection and incur a negative cash balance as 7 long as there are receivables equal to or greater than 8 the negative balance and the amount appropriated in 9 this subsection is not exceeded at the close of the 10 fiscal year. 11 2. The Iowa law enforcement academy may select 12 at least five automobiles of the department of public 13 safety, division of state patrol, prior to turning over 14 the automobiles to the department of administrative 15 services to be disposed of by public auction, and 16 the Iowa law enforcement academy may exchange any 17 automobile owned by the academy for each automobile 18 selected if the selected automobile is used in training 19 law enforcement officers at the academy. However, 20 any automobile exchanged by the academy shall be 21 substituted for the selected vehicle of the department 22 of public safety and sold by public auction with the 23 receipts being deposited in the depreciation fund to 24 the credit of the department of public safety, division 25 of state patrol. 26 Sec. 11. Section 124.401, subsection 1, paragraph 37 c, subparagraph (8), Code 2011, is amended to read as 38 follows: 39 (8) Any other controlled substance, counterfeit 40 substance, or simulated controlled substance classified 41 in schedule I, II, or III , except as provided in 42 paragraph “d” . 43 Sec. 20. Section 124.401, subsection 1, paragraph 44 d, Code 2011, is amended to read as follows: 45 d. Violation of this subsection , with respect 46 to any other controlled substances, counterfeit 47 substances, or simulated controlled substances 48 classified in section 124.204, subsection 4, 49 paragraph “ai” , or classified in schedule IV or V is 50 -14- S3233.3362.S (2) 84 jh 14/ 31
an aggravated misdemeanor. However, violation of 1 this subsection involving fifty kilograms or less of 2 marijuana or involving flunitrazepam is a class “D” 3 felony. 4 Sec. 21. 2009 Iowa Acts, chapter 178, section 20, 5 is amended to read as follows: 6 SEC. 20. CONSUMER EDUCATION AND LITIGATION 7 FUND. Notwithstanding section 714.16C, for each 8 fiscal year of the period beginning July 1, 2008, and 9 ending June 30, 2011 2013 , the annual appropriations 10 in section 714.16C, are increased from $1,125,000 to 11 $1,875,000, and $75,000 to $125,000 respectively. 12 Moneys appropriated from the consumer education and 13 litigation fund may be allocated for cash flow purposes 14 to the victim compensation fund established in section 15 915.94 during each of the fiscal years enumerated, 16 provided that any moneys so allocated are returned to 17 the consumer education and litigation fund by the end 18 of each fiscal year an allocation occurs. 19 Sec. 22. IOWA COMMUNICATIONS NETWORK. It is the 20 intent of the general assembly that the executive 21 branch agencies receiving an appropriation in this Act 22 utilize the Iowa communications network or secure other 23 electronic communications in lieu of traveling for the 24 fiscal year addressed by the appropriations. 25 Sec. 23. HOMELAND SECURITY AND EMERGENCY MANAGEMENT 26 DIVISION. There is appropriated from the wireless 27 E911 emergency communications fund created in section 28 34A.7A to the administrator of the homeland security 29 and emergency management division of the department of 30 public defense for the fiscal year beginning July 1, 31 2011, and ending June 30, 2012, an amount not exceeding 32 $200,000 to be used for implementation, support, and 33 maintenance of the functions of the administrator and 34 program manager under chapter 34A and to employ the 35 auditor of the state to perform an annual audit of the 36 wireless E911 emergency communications fund. 37 Sec. 24. GERIATRIC AND PSYCHIATRIC TREATMENT 38 —— LEGISLATIVE STUDY. The legislative council is 39 requested to establish an interim study committee 40 to examine the treatment and placement options for 41 geriatric and psychiatric patients under the care, 42 custody, and control of the state, or for patients 43 who are otherwise specifically housed at the Iowa 44 medical and classification center at Oakdale or other 45 correctional facilities for geriatric or psychiatric 46 treatment purposes. The committee shall focus on 47 maximizing the availability of treatment options for 48 such patients while achieving fiscal efficiencies. 49 The committee shall review programs used in other 50 -15- S3233.3362.S (2) 84 jh 15/ 31
states and by the federal government including but not 1 limited to the use of forensic hospitals, prison-based 2 hospice care, compassionate release, and the funding 3 mechanisms used to implement such programs. Members 4 of the interim study committee shall include the 5 co-chairpersons and the ranking members of the joint 6 appropriations subcommittee on justice system and 7 the co-chairpersons and the ranking members of the 8 joint appropriations subcommittee on human services. 9 The committee shall provide a report detailing the 10 findings of the committee to the general assembly for 11 consideration during the 2012 legislative session. 12 Sec. 25. GERIATRIC AND PSYCHIATRIC TREATMENT 13 REPORT. The departments of corrections, human 14 services, inspections and appeals, and public health, 15 and the board of parole, shall jointly study the 16 development and establishment of treatment options 17 for geriatric and psychiatric patients currently 18 under the care, custody, and control of the state 19 to provide maximum treatment opportunities for such 20 persons while achieving fiscal efficiencies. The 21 department of corrections in consultation with the 22 other departments and the board of parole, shall 23 provide a report detailing the results of the study 24 to the co-chairpersons and the ranking members of the 25 joint appropriations subcommittee on health and human 26 services, the co-chairpersons and ranking members 27 of the joint appropriations subcommittee on justice 28 system, the legislative interim study committee 29 examining such treatment options, if established by the 30 legislative council pursuant to this division of this 31 Act, and the legislative services agency by November 32 15, 2011. 33 Sec. 26. CORRECTIONAL OFFICER AND PEACE OFFICER 34 POSITIONS —— PRIORITY. As a condition of receiving 35 an appropriation in this division of this Act, the 36 department of corrections and the department of public 37 safety shall make every effort to preserve correctional 38 officer and peace officer positions through the 39 reduction of administrative and related overhead costs. 40 Sec. 27. SALARY INCREASES —— CERTAIN REVOLVING 41 FUNDS. 42 For the fiscal year beginning July 1, 2011, there is 43 appropriated from the gaming enforcement revolving fund 44 an amount necessary for funding annual pay adjustments 45 and related benefits for agents and officers of the 46 division of criminal investigation’s racetrack, 47 excursion boat, or gambling structure enforcement 48 activities. Moneys appropriated pursuant to this 49 subsection shall be in addition to and supplement other 50 -16- S3233.3362.S (2) 84 jh 16/ 31
appropriations from the fund. 1 Sec. 28. EFFECTIVE DATE. The following provision 2 of this division of this Act takes effect thirty days 3 after enactment, notwithstanding section 3.7: 4 The section of this division of this Act amending 5 section 124.204, subsection 4, paragraph “ai”, 6 subparagraphs (1) through (4). 7 Sec. 29. EFFECTIVE UPON ENACTMENT. It is the intent of the general assembly 24 that as a condition of receiving the appropriation 25 provided in this lettered paragraph the department of 26 corrections shall not, except as otherwise provided 27 in paragraph “c”, enter into a new contract, unless 28 the contract is a renewal of an existing contract, 29 for the expenditure of moneys in excess of $100,000 30 during the fiscal year beginning July 1, 2012, for the 31 privatization of services performed by the department 32 using state employees as of July 1, 2012, or for the 33 privatization of new services by the department without 34 prior consultation with any applicable state employee 35 organization affected by the proposed new contract and 36 prior notification of the co-chairpersons and ranking 37 members of the joint appropriations subcommittee on the 38 justice system. 39 b. It is the intent of the general assembly 40 that each lease negotiated by the department of 41 corrections with a private corporation for the purpose 42 of providing private industry employment of inmates in 43 a correctional institution shall prohibit the private 44 corporation from utilizing inmate labor for partisan 45 political purposes for any person seeking election to 46 public office in this state and that a violation of 47 this requirement shall result in a termination of the 48 lease agreement. 49 c. It is the intent of the general assembly that as 50 -20- S3233.3362.S (2) 84 jh 20/ 31
a condition of receiving the appropriation provided in 1 this subsection the department of corrections shall not 2 enter into a lease or contractual agreement pursuant to 3 section 904.809 with a private corporation for the use 4 of building space for the purpose of providing inmate 5 employment without providing that the terms of the 6 lease or contract establish safeguards to restrict, to 7 the greatest extent feasible, access by inmates working 8 for the private corporation to personal identifying 9 information of citizens. 10 2. It is the intent of the general assembly that 20 moneys appropriated in this subsection shall be used 21 solely for the purpose indicated and that the moneys 22 shall not be transferred for any other purpose. In 23 addition, it is the intent of the general assembly 24 that the department shall consult with the community 25 colleges in the areas in which the institutions 26 are located to utilize moneys appropriated in this 27 subsection to fund the high school completion, high 28 school equivalency diploma, adult literacy, and adult 29 basic education programs in a manner so as to maintain 30 these programs at the institutions. 31 c. To maximize the funding for educational 32 programs, the department shall establish guidelines 33 and procedures to prioritize the availability of 34 educational and vocational training for inmates based 35 upon the goal of facilitating an inmate’s successful 36 release from the correctional institution. 37 d. The director of the department of corrections 38 may transfer moneys from Iowa prison industries for use 39 in educational programs for inmates. 40 e. Notwithstanding section 8.33, moneys 41 appropriated in this subsection that remain unobligated 42 or unexpended at the close of the fiscal year shall not 43 revert but shall remain available to be used only for 44 the purposes designated in this subsection until the 45 close of the succeeding fiscal year. 46 3. It is the intent of the general assembly that 5 for the fiscal year addressed by this section the 6 department of corrections shall continue to operate the 7 correctional farms under the control of the department 8 at the same or greater level of participation and 9 involvement as existed as of January 1, 2011; shall not 10 enter into any rental agreement or contract concerning 11 any farmland under the control of the department that 12 is not subject to a rental agreement or contract as of 13 January 1, 2011, without prior legislative approval; 14 and shall further attempt to provide job opportunities 15 at the farms for inmates. The department shall attempt 16 to provide job opportunities at the farms for inmates 17 by encouraging labor-intensive farming or gardening 18 where appropriate; using inmates to grow produce 19 and meat for institutional consumption; researching 20 the possibility of instituting food canning and 21 cook-and-chill operations; and exploring opportunities 22 for organic farming and gardening, livestock ventures, 23 horticulture, and specialized crops. 24 7. The department of corrections shall solicit 25 requests for information to improve efficiencies at the 26 pharmacy under the control of the department. 27 Sec. 35. Each judicial district department of 12 correctional services, within the funding available, 13 shall continue programs and plans established within 14 that district to provide for intensive supervision, sex 15 offender treatment, diversion of low-risk offenders 16 to the least restrictive sanction available, job 17 development, and expanded use of intermediate criminal 18 sanctions. 19 3. Each judicial district department of 20 correctional services shall provide alternatives to 21 prison consistent with chapter 901B. The alternatives 22 to prison shall ensure public safety while providing 23 maximum rehabilitation to the offender. A judicial 24 district department of correctional services may also 25 establish a day program. 26 4. The governor’s office of drug control policy 27 or any succeeding entity of the governor’s office of 28 drug control policy shall consider federal grants made 29 to the department of corrections for the benefit of 30 each of the eight judicial district departments of 31 correctional services as local government grants, as 32 defined pursuant to federal regulations. 33 5. The department of corrections shall continue 34 to contract with a judicial district department 35 of correctional services to provide for the rental 36 of electronic monitoring equipment which shall be 37 available statewide. 38 Sec. 36. DEPARTMENT OF CORRECTIONS —— REALLOCATION 39 OF APPROPRIATIONS. Notwithstanding section 8.39, 40 within the moneys appropriated in this division of this 41 Act to the department of corrections, the department 42 may reallocate the moneys appropriated and allocated as 43 necessary to best fulfill the needs of the correctional 44 institutions, administration of the department, and the 45 judicial district departments of correctional services. 46 However, in addition to complying with the requirements 47 of sections 904.116 and 905.8 and providing notice 48 to the legislative services agency, the department 49 of corrections shall also provide notice to the 50 -23- S3233.3362.S (2) 84 jh 23/ 31
department of management, prior to the effective date 1 of the revision or reallocation of an appropriation 2 made pursuant to this section. The department of 3 corrections shall not reallocate an appropriation or 4 allocation for the purpose of eliminating any program. 5 Sec. 37. INTENT —— REPORTS. 6 1. The department of corrections in cooperation 7 with townships, the Iowa cemetery associations, and 8 other nonprofit or governmental entities may use inmate 9 labor during the fiscal year beginning July 1, 2012, 10 to restore or preserve rural cemeteries and historical 11 landmarks. The department in cooperation with the 12 counties may also use inmate labor to clean up roads, 13 major water sources, and other water sources around the 14 state. 15 2. On a quarterly basis the department shall 16 provide a status report regarding private-sector 17 employment to the legislative services agency beginning 18 on July 1, 2012. The report shall include the number 19 of offenders employed in the private sector, the 20 combined number of hours worked by the offenders, the 21 total amount of allowances, and the distribution of 22 allowances pursuant to section 904.702, including any 23 moneys deposited in the general fund of the state. 24 Sec. 38. ELECTRONIC MONITORING REPORT. The 25 department of corrections shall submit a report on 26 electronic monitoring to the general assembly, to the 27 co-chairpersons and the ranking members of the joint 28 appropriations subcommittee on the justice system, and 29 to the legislative services agency by January 15, 2013. 30 The report shall specifically address the number of 31 persons being electronically monitored and break down 32 the number of persons being electronically monitored 33 by offense committed. The report shall also include a 34 comparison of any data from the prior fiscal year with 35 the current year. 36 Sec. 39. STATE AGENCY PURCHASES FROM PRISON 37 INDUSTRIES. 38 1. As used in this section, unless the context 39 otherwise requires, “state agency” means the government 40 of the state of Iowa, including but not limited to 41 all executive branch departments, agencies, boards, 42 bureaus, and commissions, the judicial branch, 43 the general assembly and all legislative agencies, 44 institutions within the purview of the state board of 45 regents, and any corporation whose primary function is 46 to act as an instrumentality of the state. 47 2. State agencies are hereby encouraged to purchase 48 products from Iowa state industries, as defined in 49 section 904.802, when purchases are required and the 50 -24- S3233.3362.S (2) 84 jh 24/ 31
products are available from Iowa state industries. 1 State agencies shall obtain bids from Iowa state 2 industries for purchases of office furniture during the 3 fiscal year beginning July 1, 2012, exceeding $5,000 4 or in accordance with applicable administrative rules 5 related to purchases for the agency. 6 Sec. 40. IOWA LAW ENFORCEMENT ACADEMY. 7 1. The Iowa law enforcement academy may select 31 at least five automobiles of the department of public 32 safety, division of state patrol, prior to turning over 33 the automobiles to the department of administrative 34 services to be disposed of by public auction, and 35 the Iowa law enforcement academy may exchange any 36 automobile owned by the academy for each automobile 37 selected if the selected automobile is used in training 38 law enforcement officers at the academy. However, 39 any automobile exchanged by the academy shall be 40 substituted for the selected vehicle of the department 41 of public safety and sold by public auction with the 42 receipts being deposited in the depreciation fund to 43 the credit of the department of public safety, division 44 of state patrol. 45 Sec. 41. One additional gaming enforcement 5 officer, up to a total of four per riverboat or 6 gambling structure, may be employed for each riverboat 7 or gambling structure that has extended operations to 8 24 hours and has not previously operated with a 24-hour 9 schedule. Positions authorized in this subsection 10 are in addition to the full-time equivalent positions 11 otherwise authorized in this section. 12 Sec. 46. CIVIL RIGHTS COMMISSION. HOMELAND SECURITY AND EMERGENCY MANAGEMENT 28 DIVISION. There is appropriated from the wireless 29 E911 emergency communications fund created in section 30 34A.7A to the administrator of the homeland security 31 and emergency management division of the department of 32 public defense for the fiscal year beginning July 1, 33 2012, and ending June 30, 2013, an amount not exceeding 34 $200,000 to be used for implementation, support, and 35 maintenance of the functions of the administrator and 36 program manager under chapter 34A and to employ the 37 auditor of the state to perform an annual audit of the 38 wireless E911 emergency communications fund. 39 Sec. 48. CORRECTIONAL OFFICER AND PEACE OFFICER 40 POSITIONS —— PRIORITY.
