or
an
early

site
permit
from
the
United
States
nuclear
regulatory

commission,
or
a
utility
which
partners
with
a
utility
9
filing
an
application
or
seeking
authority,
or
a
10
utility
which
enters
into
a
purchase
agreement
to
buy
11
power
generated
by
a
nuclear
facility,
shall
be
subject
12
to
a
minimum
capacity
and
energy
savings
performance
13
standard
of
a
one
and
one-half
percent
annual
reduction
14
in
projected
energy
use
based
upon
anticipated
demand
15
and
population
shifts
within
the
utility’s
service
16
area.
The
board
shall
determine
a
date
by
which
the
17
utility
shall
annually
submit
energy
savings
results
18
achieved
during
the
preceding
twelve
months
documenting
19
the
extent
to
which
the
one
and
one-half
percent
20
reduction
standard
has
been
met.
Application
of
the
21
reduction
standard
shall
be
subject
to
the
following
22
requirements:

a.
A
utility
subject
to
this
subsection
which
24
documents
a
kilowatt-hour
or
cubic
foot
energy
usage
25
reduction
which
exceeds
the
level
corresponding
to
26
the
reduction
standard
by
more
than
one-tenth
of
one
27
percent
shall
be
entitled
to
recover
an
additional
28
one
percent
of
the
costs
of
its
energy
efficiency
29
plan
through
the
automatic
adjustment
mechanism
under
30
section
476.6,
subsection
8,
for
each
one-tenth
of
one
31
percent
by
which
the
reduction
standard
is
exceeded.

b.
A
utility
subject
to
this
subsection
which
33
documents
a
reduction
that
fails
to
meet
the
reduction
34
standard
by
more
than
one-tenth
of
one
percent
shall
35
be
subject
to
an
assessment
imposed
by
the
board.
36
The
electric
utility
shall
be
assessed
two
cents
for
37
each
kilowatt-hour
of
energy
savings
achieved
below
38
the
level
corresponding
to
the
reduction
standard,
39
and
shall
be
subject
to
an
assessment
of
twenty
40
cents
for
each
hundred
cubic
feet
of
energy
savings
41
achieved
below
the
level
corresponding
to
the
reduction
42
standard.
Amounts
assessed
shall
be
remitted
to
43
the
board
for
allocation
to
an
independent
energy
44
efficiency
administrator
selected
by
the
board
on
a
45
competitive
basis
to
improve
energy
efficiency
in
a
46
manner
established
by
the
board
by
rule
in
the
service
47
area
of
the
utility.

The
board
shall
designate

qualifying

sold
by

vehicles,
and
may
permit
allocation
5
of
energy
efficiency
expenditures
that
do
not
have
a
6
demonstrated
cost-effectiveness
if
the
board
determines
7
the
expenditures
contribute
to
achievement
of
the
8
standard.
The
board
may
allocate
additional
weighting
9
to
energy
efficiency
programs
for
qualified
low-income
10
persons
in
achieving
the
reduction
standard.
11
d.
A
utility
otherwise
subject
to
the
reduction
12
standard
may
elect
to
opt
out
of
compliance
with
the
13
standard
by
agreeing
to
an
assessment
determined
by
14
the
board
in
an
amount
corresponding
to
or
sufficient
15
to
attain
the
standard,
which
shall
be
remitted
to
16
the
board
for
allocation
to
an
independent
energy
17
efficiency
administrator
selected
by
the
board
as
18
provided
in
paragraph
“b”
.
