Gives the applicant the power of eminent domain 8 to the extent and under such conditions as the board 9 may approve, prescribe and find necessary for the 10 public convenience, use and necessity, proceeding 11 in the manner of works of internal improvement under 12 chapter 6B . The burden of proving the necessity for the 13 exercise of the power of eminent domain shall be on the 14 person issued the certificate. This paragraph shall 15 apply to an applicant for the construction of a nuclear 16 generating facility to the same extent as an applicant 17 for the construction of any other nonnuclear generating 18 facility. >> 19 2.
