Any civil penalty collected by 6 the state or a county relating to the construction of 7 semipublic sewage disposal systems shall be deposited 8 in the unsewered community revolving loan fund created 9 pursuant to section 16.141. > 10 2. The department shall find that a regulated 14 entity and the affected community are a disadvantaged 15 community by using evaluating all of the following 16 criteria : 17 a. The ability of the regulated entity and the 18 affected community to pay for a project based on the 19 ratio of the total annual project costs per household 20 to median household income. 21 b. Median household income in the community as 22 a percentage of statewide household income and the 23 unemployment rate of the county in which the community 24 is located . 25 b. Annual water and sewer rates as a percentage of 26 median household income. 27 c. Families below the poverty level in the 28 community as a percentage of the statewide number of 29 families below the poverty level. 30 d. Per capita The outstanding debt of the system as 31 a percentage of median household income and the bond 32 rating of the community . 33 e. Cost effectiveness calculated by determining 34 construction costs per user. 35 Sec. ___. Section 455B.199B, Code 2011, is amended 36 by adding the following new subsections: 37 NEW SUBSECTION . 2A. The department shall find that 38 an unsewered community is a disadvantaged community by 39 evaluating all of the following: 40 a. The ability of the community to pay for a 41 project based on the ratio of the total annual project 42 costs per household to median household income. 43 b. The unemployment rate in the county where the 44 community is located. 45 c. The median household income of the community. 46 NEW SUBSECTION . 2B.
