Any official traffic-control device, if failure 4 to comply with the official traffic-control device 5 constitutes a violation under this chapter. 6 Sec. ___. NEW SECTION . 321.5A Automated traffic 7 enforcement systems prohibited. 8 The department or a local authority shall not place 9 or cause to be placed on or adjacent to a highway, or 10 maintain or employ the use of, an automated traffic 11 enforcement system for the enforcement of any provision 12 of this chapter or any local ordinance relating to 13 motor vehicles. 14 Sec. ___. REMOVAL OF AUTOMATED TRAFFIC ENFORCEMENT 15 SYSTEMS —— VALIDITY OF PRIOR NOTICES AND CITATIONS. A 16 local authority using an automated traffic enforcement 17 system on the effective date of this section of this 18 Act shall discontinue using the system and remove the 19 system equipment by July 1, 2011. Effective July 1, 20 2011, all local ordinances authorizing the use of 21 an automated traffic enforcement system are void. 22 However, notices of violations mailed or citations 23 issued pursuant to such an ordinance prior to July 1, 24 2011, shall not be invalidated by the enactment of this 25 Act and shall be processed according to the provisions 26 of the law under which they were authorized. 27 Sec. ___. EFFECTIVE UPON ENACTMENT. The section of 28 this Act relating to the removal of automated traffic 29 enforcement systems and the validity of prior notices 30 and citations, being deemed of immediate importance, 31 takes effect upon enactment. > 32 2.
