Section 256.9, Code 2011, is amended by 3 adding the following new subsection: 4 NEW SUBSECTION . 62. Provide that a background 5 investigation be conducted by the division of criminal 6 investigation of the department of public safety on 7 a person responsible for or providing independent 8 private instruction in accordance with section 299A.1, 9 subsection 2. The director shall require such persons 10 to submit a completed fingerprint packet and shall 11 use the packet to facilitate a national criminal 12 history background check. If the results of the 13 background investigation determine that the subject 14 of the investigation has been convicted of a felony 15 offense, instruction provided by or instruction for 16 which the person is responsible shall not be considered 17 independent private instruction for purposes of chapter 18 299 or chapter 299A. > 19 2.
