House File 470 H-1291 Amend House File 470 as follows: 1 1. Page 3, after line 14 by inserting: 2 < Sec. ___. Section 123.50, Code 2011, is amended by 3 adding the following new subsection: 4 NEW SUBSECTION . 5. If an employee of a licensee 5 or permittee violates section 123.49, subsection 2, 6 paragraph “h” , the licensee or permittee shall not 7 be assessed a penalty under subsection 3, and the 8 violation shall be deemed not to be a violation of 9 section 123.49, subsection 2, paragraph “h” , for the 10 purpose of determining the number of violations for 11 which a penalty may be assessed pursuant to subsection 12 3, if the employee holds a valid certificate of 13 completion of the alcohol compliance employee training 14 program pursuant to section 123.50A at the time of 15 the violation. A licensee or permittee may assert 16 only once in a four-year period the bar under this 17 subsection against assessment of a penalty pursuant to 18 subsection 3, for a violation of subsection 123.49, 19 subsection 2, paragraph “h” , that takes place at the 20 same place of business location. 21 Sec. ___. NEW SECTION . 123.50A Alcohol compliance 22 employee training program. 23 1. If sufficient funding is appropriated, the 24 division shall develop an alcohol compliance employee 25 training program, not to exceed two hours in length 26 for employees and prospective employees of licensees 27 and permittees, to inform the employees about state 28 and federal liquor laws and regulations regarding the 29 sale of alcoholic liquor, wine, or beer to persons 30 under legal age, and compliance with and the importance 31 of laws regarding the sale of alcoholic liquor, wine, 32 or beer to persons under legal age. In developing 33 the alcohol compliance employee training program, 34 the division may consult with stakeholders who have 35 expertise in the laws and regulations regarding the 36 sale of alcoholic liquor, wine, or beer to persons 37 under legal age. 38 2. The alcohol compliance employee training program 39 shall be made available to employees and prospective 40 employees of licensees and permittees at no cost to the 41 employee, the prospective employee, or the licensee or 42 permittee, and in a manner which is as convenient and 43 accessible to the extent practicable throughout the 44 state so as to encourage attendance. Contingent upon 45 the availability of specified funds for provision of 46 the program, the division shall schedule the program 47 on at least a monthly basis and the program shall be 48 available at a location in at least a majority of 49 counties. 50 -1- HF470.1475 (1) 84 rn/nh 1/ 2 #1.

Upon completion of the alcohol compliance 1 employee training program, an employee or prospective 2 employee shall receive a certificate of completion, 3 which shall be valid for a period of two years, unless 4 the employee or prospective employee is convicted of a 5 violation of section 123.49, subsection 2, paragraph 6 “h” , in which case the certificate shall be void. 7 4. The division shall also offer periodic 8 continuing employee training and recertification for 9 employees who have completed initial training and 10 received an initial certificate of completion as part 11 of the alcohol compliance employee training program. > 12 2.
