Section 717B.3A, subsection 3, paragraph 3 a, subparagraphs (1) and (2), Code 2011, are amended 4 to read as follows: 5 (1) For the first or a subsequent conviction, the 6 person is guilty of an aggravated misdemeanor a class 7 “D” felony . The sentencing order shall provide that 8 the person submit to psychological evaluation and 9 treatment according to terms required by the court. 10 The costs of the evaluation and treatment shall be 11 paid by the person. In addition, the sentencing order 12 shall provide that the person complete a community 13 work requirement, which may include a work requirement 14 performed at an animal shelter or pound, as defined 15 in section 162.2 , according to terms required by the 16 court. 17 (2) For a second or subsequent conviction, 18 the person is guilty of a class “D” felony. The 19 sentencing order shall provide that the person submit 20 to psychological evaluation and treatment according 21 to terms required by the court.
