Section 68A.405, subsection 1, 3 paragraphs a and b, Code 2011, are amended to read as 4 follows: 5 a. For purposes of this subsection : 6 (1) “Individual” includes a candidate for public 7 office who has not filed a statement of organization 8 under section 68A.201 . 9 (2) “Organization” includes an organization 10 established to advocate the passage or defeat of a 11 ballot issue but that has not filed a statement of 12 organization under section 68A.201 . 13 (3) “Published material” means any newspaper, 14 magazine, shopper, outdoor advertising facility, 15 poster, direct mailing, brochure, internet website, 16 campaign sign, or any other form of printed general 17 public political advertising. “Published material” 18 includes television, radio, video, or motion picture 19 advertising. 20 b. (1) Except as set out in subsection 2 , 21 published material , or automated telephone calls 22 designed to expressly advocate the nomination, 23 election, or defeat of a candidate for public office or 24 the passage or defeat of a ballot issue shall include 25 on the published material an attribution statement 26 disclosing who is responsible for the published 27 material. 28 (2) Automated telephone calls made by a person or 29 organization for the purpose of gathering information 30 about or to influence an election for a public office 31 shall include a disclaimer clearly identifying the name 32 of the caller, the name of the person or organization 33 funding the communication, and the name and telephone 34 number of an authorized person responsible for the 35 communication. 36 (2) (3) The person who is responsible for the 37 published material has the sole responsibility and 38 liability for the attribution statement required by 39 this section. > 40 2.
