If that Monday 27 or Tuesday is a public holiday, section 4.1, subsection 28 34 , controls. 29 Sec. ___. Section 50.46, Code 2011, is amended to 30 read as follows: 31 50.46 Special elections —— canvass and certificate. 32 When a special election has been held to fill a 33 vacancy, pursuant to section 69.14 , the board of 34 county canvassers shall meet no earlier than 1:00 p.m. 35 on the second day after the election, on the first 36 Tuesday following the election and canvass the votes 37 cast at the election. If the second day first Tuesday 38 after the election is a public holiday, section 4.1, 39 subsection 34 , controls. The commissioner, as soon as 40 the canvass is completed, shall transmit to the state 41 commissioner an abstract of the votes so canvassed, 42 and the state board, within five days after receiving 43 such abstracts, shall canvass the tally lists. Special elections held in 23 school districts shall be canvassed at the time and 24 in the manner required by that section. The board 25 shall declare the results of the voting for members of 26 boards of directors of school corporations nominated 27 pursuant to section 277.4 , and the commissioner shall 28 at once issue a certificate of election to each person 29 declared elected. The board shall also declare the 30 results of the voting on any public question submitted 31 to the voters of a single school district, and the 32 commissioner shall certify the result as required by 33 section 50.27 . > 34 6. Section 376.9, subsection 1, Code 2011, 10 is amended to read as follows: 11 1. A runoff election may be held only for positions 12 unfilled because of failure of a sufficient number of 13 candidates to receive a majority vote in the regular 14 city election. When a council has chosen a runoff 15 election in lieu of a primary, the county board of 16 supervisors shall publicly canvass the tally lists of 17 the vote cast in the regular city election, following 18 the procedures prescribed in section 50.24 , at a 19 meeting to be held on the second day first Tuesday 20 following the regular city election , and beginning no 21 earlier than 1:00 p.m. on that day . Candidates who 22 do not receive a majority of the votes cast for an 23 office, but who receive the highest number of votes 24 cast for that office in the regular city election, to 25 the extent of twice the number of unfilled positions, 26 are candidates in the runoff election. > 27 7.
