     1 34    1.  In lieu of 2010 Iowa Acts, House File 2519,
     1 35 section 19, if additional funding designated for
     1 36 education stabilization is made available for the
     1 37 fiscal year beginning July 1, 2010, through the state
     1 38 fiscal stabilization fund established pursuant to the
     1 39 federal American Recovery and Reinvestment Act of 2009,
     1 40 Pub. L. No. 111=5, such funding shall be credited to
     1 41 the federal recovery and reinvestment fund created in
     1 42 section 8.41A and is appropriated for the fiscal year
     1 43 beginning July 1, 2010, and ending June 30, 2011, to
     1 44 the departments and agencies that received the funding
     1 45 designated for education stabilization in 2009 Iowa
     1 46 Acts, chapter 183, section 61, subsection 1.
     1 47    2.  a.  Except as otherwise provided in paragraph
     1 48 "b", the amounts of the individual appropriations made
     1 49 in subsection 1 shall be in the same proportion as the
     1 50 individual appropriations in 2009 Iowa Acts, chapter
     2  1 183, section 61, subsection 1, bear to the total amount
     2  2 appropriated in that provision.
     2  3    b.  (1)  The amount appropriated pursuant to
     2  4 subsection 1 for state foundation aid to schools shall
     2  5 not exceed the difference between the amount determined
     2  6 for the standing appropriation for state foundation
     2  7 aid for the fiscal year pursuant to section 257.16,
     2  8 subsection 1, and the amount the standing appropriation
     2  9 was limited to pursuant to this division of this Act.
     2 10    (2)  The amount appropriated for the fiscal year
     2 11 pursuant to subsection 1 for instructional support
     2 12 state aid under section 257.20 shall not exceed
     2 13 $5,609,950, shall be in addition to the appropriation
     2 14 made in this division of this Act for the same purpose
     2 15 from the school infrastructure fund, and shall be
     2 16 allocated as provided in the school infrastructure fund
     2 17 appropriation.
     2 18    3.  a.  Except as provided in subsection 2 for
     2 19 instructional support state aid, the distribution of
     2 20 each appropriation made pursuant to subsection 1 to
     2 21 subunits of the departments and agencies shall also be
     2 22 in the same proportion as the distribution to subunits
     2 23 of the individual appropriations in 2009 Iowa Acts,
     2 24 chapter 183, section 61, subsection 1.  However, state
     2 25 foundation aid to school districts shall be distributed
     2 26 based on 2010 Iowa Acts, House File 2519, section 20,
     2 27 subsection 1.
     2 28    b.  If good cause exists, as determined by
     2 29 the departments of education and management, in
     2 30 coordination with the office of the governor,
     2 31 adjustments may be made to distribution proportions to
     2 32 the subunits other than as provided in paragraph "a".
     2 33    4.  The department of management shall report to the
     2 34 chairpersons and ranking members of the appropriations
     2 35 committees of the senate and house of representatives
     2 36 and the legislative services agency concerning any
     2 37 appropriations and distributions made pursuant to this
     2 38 section, within two weeks of such appropriations and
     2 39 distributions being made. >>

     3 21 amended by adding the following new subsection:
     3 22    NEW SUBSECTION.  4A.  a.  During the period of
     3 23 funding for the Iowa power fund as provided in section
     3 24 469.10, the office of energy independence shall collect
     3 25 data on all grants and loans approved for funding.
     3 26 The department of management and the state agencies
     3 27 associated with the grants and loans shall assist the
     3 28 office with the data collection and in developing
     3 29 the report required by this subsection.  The office
     3 30 shall report quarterly to the governor and the general
     3 31 assembly concerning the data.
     3 32    b.  The report shall include but is not limited to
     3 33 all of the following:
     3 34    (1)  The nature of each grant or loan and its
     3 35 purpose.
     3 36    (2)  The status of each grant or loan and the amount
     3 37 and percentage of power fund moneys expended for the
     3 38 grant or loan.
     3 39    (3)  The outside funding that is matched or
     3 40 leveraged by power fund moneys.
     3 41    (4)  The number of jobs created or retained due to
     3 42 each grant or loan.
     3 43    (5)  For each grant or loan, the names of the grant
     3 44 or loan contractors, their state of residence, and the
     3 45 state of residence of the contractors' employees.
     3 46    c.  The office shall maintain an internet site that
     3 47 allows citizens to track data on a county=by=county
     3 48 basis. >>

     4  6 school district received pursuant to section 291.10,
     4  7 subsection 2, and shall submit the information to the
     4  8 general assembly in an annual report each February 1.
     4  9    Sec. ___.  Section 291.10, Code 2009, is amended to
     4 10 read as follows:
     4 11    291.10  Reports by secretary.
     4 12    1.  The school district shall file an annual report
     4 13 with the director of the department of education on
     4 14 forms prepared for that purpose.
     4 15    2.  The annual report shall include the financial
     4 16 information required in section 423F.5, subsection 1,
     4 17 as related to moneys received under chapter 423E or
     4 18 423F, as applicable, for each budget year. >>
