By striking page 207, line 7, through page 210, 1 5 line 16, and inserting: 1 6 <Sec. ___. SHIFTING OF PROGRAMS AT STATE MENTAL 1 7 HEALTH INSTITUTES. 1 8 1. The department of human services shall commence 1 9 all of the following during the fiscal year beginning 1 10 July 1, 2010: 1 11 a. Shifting the program for juveniles from 1 12 the Cherokee state mental health institute to the 1 13 Independence state mental health institute. 1 14 b. Shifting the adult psychiatric program from the 1 15 Clarinda state mental health institute to the Cherokee 1 16 state mental health institute. 1 17 c. Shifting the gero=psychiatric program from 1 18 the Clarinda state mental health institute to one or 1 19 more other locations where quality services can be 1 20 provided under the program in a cost=effective manner. 1 21 In implementing this paragraph, the department shall 1 22 consider all of the following: 1 23 (1) Developing the program to operate in smaller 1 24 separate units and taking other measures to enable 1 25 the program to qualify for medical assistance program 1 26 funding. 1 27 (2) Possible program locations at the Glenwood 1 28 state resource center, a local hospital or health care 1 29 facility with suitable available space, or the Iowa 1 30 veterans home. 1 31 2. The department of human services shall work with 1 32 the affected patients and their families and advocates, 1 33 the department of corrections and other state agencies 1 34 involved, affected state employees, counties and other 1 35 units of local government, and other stakeholders 1 36 in order to minimize any adverse impacts that could 1 37 result from the shifting of programs in accordance with 1 38 subsection 1. 1 39 3. The department of human services may adopt 1 40 administrative rules under section 17A.4, subsection 1 41 2, and section 17A.5, subsection 2, paragraph "b", to 1 42 implement the provisions of this section and the rules 1 43 shall become effective immediately upon filing or on a 1 44 later effective date specified in the rules, unless the 1 45 effective date is delayed by the administrative rules 1 46 review committee. Any rules adopted in accordance 1 47 with this subsection shall not take effect before 1 48 the rules are reviewed by the administrative rules 1 49 review committee. The delay authority provided to the 1 50 administrative rules review committee under section 2 1 17A.4, subsection 5, and section 17A.8, subsection 2 2 9, shall be applicable to a delay imposed under this 2 3 subsection, notwithstanding a provision in those 2 4 sections making them inapplicable to section 17A.5, 2 5 subsection 2, paragraph "b". Any rules adopted in 2 6 accordance with the provisions of this subsection 2 7 shall also be published as notice of intended action as 2 8 provided in section 17A.4. 2 9 4. The department of human services shall propose 2 10 legislation in accordance with section 2.16 to provide 2 11 any amendments to permanent law necessary to reflect 2 12 the program changes made pursuant to this section.> 2 13 #3.
