     3 22    In consultation with the state council, the
     3 23 department shall establish a bureau of early childhood
     3 24 services.  The functions of the bureau shall include
     3 25 but are not limited to all of the following:
     3 26    1.  Develop a definition of at=risk children for
     3 27 the purposes of this chapter.  The definition shall
     3 28 include income, family structure, the child's level of
     3 29 development, and availability or accessibility for the
     3 30 child of a head start or other child care program as
     3 31 criteria.
     3 32    2.  Establish minimum guidelines for comprehensive
     3 33 early care and early child development services for
     3 34 at=risk children from zero through age five.  The
     3 35 guidelines shall reflect current research findings
     3 36 on the necessary components for cost=effective child
     3 37 development services.
     3 38    3.  At least biennially, develop an inventory of
     3 39 child development services provided to at=risk children
     3 40 from zero through age five in this state and identify
     3 41 the number of children receiving and not receiving
     3 42 these services, the types of programs under which
     3 43 the services are received, the degree to which each
     3 44 program meets the department's minimum guidelines for
     3 45 a comprehensive program, and the reasons children
     3 46 not receiving the services are not being served.  The
     3 47 bureau is not required to conduct independent research
     3 48 in developing the inventory, but shall determine
     3 49 information needs necessary to provide a more complete
     3 50 inventory.
     4  1    4.  a.  Subject to the availability of funds
     4  2 appropriated or otherwise available for the purpose
     4  3 of providing child development services, award grants
     4  4 for programs that provide new or additional child
     4  5 development services to at=risk children.
     4  6    b.  In awarding program grants to an agency or
     4  7 individual, the bureau shall consider the following:
     4  8    (1)  The quality of the staff and staff background
     4  9 in child development services.
     4 10    (2)  The degree to which the program is or will be
     4 11 integrated with existing community resources and has
     4 12 the support of the local community.
     4 13    (3)  The ability of the program to provide for child
     4 14 care in addition to child development services for
     4 15 families needing full=day child care.
     4 16    (4)  A staff=to=children ratio within the guidelines
     4 17 established under subsection 2, but not less than one
     4 18 staff member per eight children.
     4 19    (5)  The degree to which the program involves and
     4 20 works with the parents, and includes home visits,
     4 21 instruction for parents on parenting skills, on
     4 22 enhancement of skills in providing for their children's
     4 23 learning and development, and the physical, mental, and
     4 24 emotional development of children, and experiential
     4 25 education.
     4 26    (6)  The manner in which health, medical, dental,
     4 27 and nutrition services are incorporated into the
     4 28 program.
     4 29    (7)  The degree to which the program complements
     4 30 existing programs and services for at=risk children
     4 31 from zero through age five available in the area,
     4 32 including other child care services, services provided
     4 33 through the school district, and services available
     4 34 through area education agencies and early childhood
     4 35 Iowa areas.
     4 36    (8)  The degree to which the program can be
     4 37 monitored and evaluated to determine its ability to
     4 38 meet its goals.
     4 39    (9)  The provision of transportation or other
     4 40 auxiliary services that may be necessary for families
     4 41 to participate in the program.
     4 42    (10)  The provision of staff training and
     4 43 development, and staff compensation sufficient to
     4 44 assure continuity.
     4 45    c.  Program grants funded under this subsection may
     4 46 integrate children not meeting at=risk criteria into
     4 47 the program and shall establish a fee for participation
     4 48 in the program in the manner provided in section
     4 49 279.49, but grant funds shall not be used to pay the
     4 50 costs for those children.
     5  1    5.  a.  Encourage the submission of grant requests
     5  2 from all potential providers of early care and early
     5  3 childhood services and shall be flexible in evaluating
     5  4 grants, recognizing that different types of programs
     5  5 may be suitable for different locations in the state.
     5  6 However, requests for grants must contain a procedure
     5  7 for evaluating the effectiveness of the program and
     5  8 accounting procedures for monitoring the expenditure
     5  9 of grant moneys.
     5 10    b.  The bureau shall seek to use performance=based
     5 11 measures to evaluate programs.  Not more than five
     5 12 percent of any state funds appropriated for child
     5 13 development purposes may be used for administration and
     5 14 evaluation.
     5 15    6.  Subject to a decision by the state board to
     5 16 initiate the programs, develop criteria for and award
     5 17 grants under section 279.51, subsection 2.
     5 18    7.  Work to align the early childhood programs
     5 19 and other support addressed by this chapter with the
     5 20 federally funded early childhood programs and the
     5 21 statewide preschool program for four=year=old children
     5 22 implemented pursuant to chapter 256C.
     5 23    8.  Work with area boards, school districts, area
     5 24 education agencies, and other state agencies to provide
     5 25 leadership for development of the comprehensive early
     5 26 childhood system.  The leadership functions shall
     5 27 include but are not limited to all of the following:
     5 28    a.  Develop and keep current memoranda of
     5 29 understanding between the state agencies represented
     5 30 on the state council to promote development and
     5 31 integration of the comprehensive early childhood system
     5 32 and to clarify the roles and responsibilities of those
     5 33 agencies.>

     6 34 programs.
     6 35    1.  a.  The board of directors of each school
     6 36 district may develop, offer, and promote a program
     6 37 which provides outreach and incentives for the
     6 38 voluntary participation of expectant parents and
     6 39 parents of children in the period of life from
     6 40 zero through age five, who reside within district
     6 41 boundaries, in educational family support and parent
     6 42 education experiences designed to assist parents in
     6 43 learning about the health needs and physical, mental,
     6 44 social, and emotional development of their children.
     6 45 The program shall be offered in a flexible manner
     6 46 to accommodate the varying schedules, meeting place
     6 47 requirements, and other needs of working parents. The
     6 48 program shall include home visitation. A board may
     6 49 contract with another school district or public or
     6 50 private nonprofit agency for provision of the approved
     7  1 program or program site.
     7  2    b.  A family support program shall meet
     7  3 multicultural gender fair guidelines.  The program
     7  4 shall encourage parents to be aware of practices
     7  5 that may affect equitable development of children.
     7  6 The program shall include parents in the planning,
     7  7 implementation, and evaluation of the program.  A
     7  8 program shall be designed to meet the needs of the
     7  9 residents of the participating district and may use
     7 10 unique approaches to provide for those needs.  The
     7 11 goals of a family support program shall include but are
     7 12 not limited to the following:
     7 13    (1)  Family involvement as a key component of
     7 14 school improvement with an emphasis on communication
     7 15 and active family participation in family support
     7 16 programming.
     7 17    (2)  Family participation in the planning
     7 18 and decision=making process for the program and
     7 19 encouragement of long=term parental involvement in
     7 20 their children's education.
     7 21    (3)  Meeting the educational and developmental needs
     7 22 of expectant parents and parents of young children.
     7 23    (4)  Developmentally appropriate activities for
     7 24 children that include those skills necessary for
     7 25 adaptation to both the home and school environments.
     7 26    (5)  Addressing the health needs and social
     7 27 development of young children.
     7 28    2.  The department shall develop guidelines for
     7 29 family support programs.  Program components may
     7 30 include but are not limited to all of the following:
     7 31    a.  Instruction, techniques, and materials designed
     7 32 to educate parents about the physical, mental,
     7 33 character, and emotional development of children.
     7 34    b.  Instruction, techniques, and materials designed
     7 35 to enhance the skills of parents in assisting in their
     7 36 children's learning and development.
     7 37    c.  Assistance to parents about learning experiences
     7 38 for both children and parents.
     7 39    d.  Activities, such as developmental screenings,
     7 40 designed to detect children's physical, mental,
     7 41 emotional, or behavioral problems that may cause
     7 42 learning problems and referrals to appropriate
     7 43 agencies, authorities, or service providers.
     7 44    e.  Activities and materials designed to encourage
     7 45 parents' and children's self=esteem and to enhance
     7 46 parenting skills and both parents' and children's
     7 47 appreciation of the benefits of education.
     7 48    f.  Information on related community resources,
     7 49 programs, or activities.
     7 50    g.  Role modeling and mentoring techniques for
     8  1 families of children who meet one or more of the
     8  2 criteria established for the definition of at=risk
     8  3 children by the bureau of early childhood services.
     8  4    3.  Family support programs shall be provided by
     8  5 family support program educators who have completed a
     8  6 minimum of thirty clock hours of an approved family
     8  7 support preservice or in=service training program and
     8  8 meet one of the following requirements:
     8  9    a.  The family support program educator is licensed
     8 10 in elementary education, early childhood education,
     8 11 early childhood special education, home economics, or
     8 12 consumer and homemaking education, or is licensed or
     8 13 certified in occupational child care services and has
     8 14 demonstrated an ability to work with young children and
     8 15 their parents.
     8 16    b.  The family support program educator has achieved
     8 17 child development associate recognition in early
     8 18 childhood education, has completed programming in
     8 19 child development and nursing, and has demonstrated an
     8 20 ability to work with young children and their parents.
     8 21    c.  The family support program educator has
     8 22 completed sixty college credit hours and possesses two
     8 23 years of experience in a program working with young
     8 24 children and their parents.
     8 25    d.  The family support program educator possesses
     8 26 five years of experience in a program working with
     8 27 young children and their parents.
     8 28    4.  Each district shall maintain a separate account
     8 29 within the district budget for moneys allocated for
     8 30 family support programs.  A district may receive moneys
     8 31 from state and federal sources, and may solicit funds
     8 32 from private sources, for deposit into the account.
     8 33    5.  A district shall coordinate a family support
     8 34 program with district special education and vocational
     8 35 education programs and with any related services or
     8 36 programs provided by other state, federal, or private
     8 37 nonprofit agencies.>

    11 34 b and d, Code 2009, are amended to read as follows:
    11 35    b.  For the fiscal year beginning July 1, 2007, and
    11 36 for each succeeding fiscal year, eight million five
    11 37 hundred thirty=six thousand seven hundred forty dollars
    11 38 of the funds appropriated shall be allocated to the
    11 39 child development coordinating council established in
    11 40 chapter 256A for the purposes set out in subsection 2
    11 41 of this section and early care and child development
    11 42 programs under section 256A.3 256I.5.
    11 43    d.  Notwithstanding section 256A.3, subsection
    11 44 6, any provision to the contrary, of the amount
    11 45 appropriated in this subsection for the fiscal year
    11 46 beginning July 1, 2007, and for each succeeding fiscal
    11 47 year, up to two hundred eighty=two thousand six hundred
    11 48 dollars may be used for administrative costs.
    11 49 Sec. ___.  Section 279.51, subsection 2, paragraph
    11 50 a, Code 2009, is amended to read as follows:
    12  1    a.  To continue funding for programs previously
    12  2 funded by grants awarded under section 256A.3, Code
    12  3 2009, and to provide additional early care and child
    12  4 development grants under section 256A.3 chapter 256I.
    12  5 The council department of education shall seek to
    12  6 provide grants on the basis of the location within the
    12  7 state of children meeting at=risk definitions.
    12  8 Sec. ___.  Section 279.51, subsection 2, paragraph
    12  9 b, unnumbered paragraph 1, Code 2009, is amended to
    12 10 read as follows:
    12 11    At the discretion of the child development
    12 12 coordinating council department of education, award
