1 17 to advance the policy as a goal for the supervisory

1 21 policy.
1 22 1. The state board of regents shall develop and
1 23 maintain a policy regarding the aggregate ratio of the
1 24 number of employees per supervisory employee at each of
1 25 the institutions under the control of the board subject
1 26 to the requirements of this section.
1 27 2. The target span of control aggregate ratio of
1 28 supervisory employees to other employees shall be one
1 29 to fifteen. The target span of control ratio shall
1 30 not apply to employees involved with direct patient
1 31 care, faculty, and employees in other areas of the
1 32 institutions that must maintain different span of
1 33 control ratios due to federal or state regulations.
1 34 3. For the purposes of this section, "supervisory
1 35 employee" means a public employee who is not a member
1 36 of a collective bargaining unit and who has authority,
1 37 in the interest of a public employer, to hire,
1 38 transfer, suspend, lay off, recall, promote, discharge,
1 39 assign, reward, or discipline other public employees,
1 40 to direct such public employees, or to adjust the
1 41 grievances of such public employees, or to effectively
1 42 recommend any such action.
1 43 4. The policy shall allow departments within an
1 44 institution under the control of the state board of
1 45 regents with twenty=eight or fewer full=time equivalent
1 46 employee positions to be granted an exception to the
1 47 policy by the board. Departments applying for an
1 48 exception shall file a statement of need with the
1 49 applicable institutional human resources office and the
1 50 office shall make a recommendation to the state board
2 1 of regents.
2 2 5. The state board of regents shall present an
2 3 interim report to the governor and general assembly on
2 4 or before April 1, 2010, with annual updates detailing
2 5 the effects of the policy on the composition of the
2 6 workforce, cost savings, efficiencies, and outcomes.
2 7 In addition, the report and annual updates shall
2 8 identify those departments within each institution
2 9 under the control of the board granted an exception by
2 10 the board to the policy as provided in this section.>

2 15 Sec. ___. NEW SECTION. 262.9B Cooperative
2 16 purchasing.
2 17 1. Overview. The state board of regents for
2 18 institutions under its control shall coordinate
2 19 interagency cooperation with state agencies, as
2 20 defined in section 8A.101, in the area of purchasing
2 21 and information technology with the goal of annually
2 22 increasing the amount of joint purchasing. The
2 23 board and the institutions under the control of the
2 24 board shall engage the department of administrative
2 25 services and other state agencies in pursuing mutually
2 26 beneficial activities relating to purchasing items and
2 27 acquiring information technology. The board and the
2 28 institutions shall explore ways to leverage resources,
2 29 identify cost savings, implement efficiencies,
2 30 and improve effectiveness without compromising the
2 31 mission of the board and the institutions under the
2 32 control of the board relative to students and research
2 33 commitments.
2 34 2. Purchasing.
2 35 a. The board shall direct the institutions under
2 36 its control to cooperate with the department of
2 37 administrative services and other state agencies in
2 38 efforts to collaboratively purchase goods and services
2 39 that result in mutual cost savings and efficiency
2 40 improvements.
2 41 b. The board and the institutions under its control
2 42 shall assist the department of administrative services
2 43 by doing the following:
2 44 (1) Identifying best practices that produce cost
2 45 savings and improve state government processes.
2 46 (2) Exploring joint purchases of general use items
2 47 that result in mutual procurement of quality goods and
2 48 services at the lowest reasonable cost.
2 49 (3) Exploring flexibility, administrative relief,
2 50 and transformational changes through procurement
3 1 technology.
3 2 c. The board shall convene at least quarterly
3 3 an interagency purchasing group meeting including
3 4 the institutions under its control, the department
3 5 of administrative services, the department of
3 6 transportation, and any other state agency, for the
3 7 purposes of timely cooperation in purchasing goods
3 8 and services and for the identification of practical
3 9 measures that improve state agency performance of
3 10 programs and operations, reduce total costs of state
3 11 government operations, increase productivity, improve
3 12 services and make state government more responsive and
3 13 accountable to the public.
3 14 3. Information technology.
3 15 a. The board shall direct institutions under
3 16 its control to cooperate with the chief information
3 17 officer of the state in efforts to cooperatively obtain
3 18 information technology and related services that result
3 19 in mutual cost savings and efficiency improvements.
3 20 b. The board shall convene at least quarterly
3 21 an interagency information technology group meeting
3 22 including the institutions under its control, the state
3 23 chief information officer and any other agency, for
3 24 purposes of timely cooperation in obtaining information
3 25 technology and related services.
3 26 4. Cooperative purchasing plan. The board shall,
3 27 before July 1, of each year, prepare a plan that
3 28 identifies specific areas of cooperation between the
3 29 institutions under its control, the department of
3 30 administrative services, and the chief information
3 31 officer of the state, that will be addressed for the
3 32 next fiscal year including timelines for implementing,
3 33 analyzing, and evaluating each of the areas of
3 34 cooperation. The plan shall also identify the
3 35 potential for greater interinstitutional cooperation in
3 36 areas that would result in a net cost savings.
3 37 5. Report. The board shall, on or before November
3 38 1, submit a report to the general assembly and the
3 39 governor providing information on the cooperative
3 40 purchasing plan prepared for that fiscal year by the
3 41 board and on the results of the quarterly interagency
3 42 meetings, including the specific cost savings or
3 43 efficiency gains that have resulted from utilization
3 44 of cooperative efforts and the implementation of
3 45 identified best practices.>

4 21 and any other state agency exempt from centralized
4 22 purchasing to explore joint purchases of general use
4 23 items that present opportunities to obtain quality
4 24 goods and services at the lowest reasonable cost.>
