Page 29, by inserting after line 29 the 1 4 following: 1 5 <Sec. . 2009 Iowa Acts, Senate File 376, 1 6 section 13, subsection 5, if enacted, is amended by 1 7 striking the subsection and replacing in lieu thereof, 1 8 the following: 1 9 <5. IOWA TELECOMMUNICATIONS AND TECHNOLOGY 1 10 COMMISSION 1 11 For broadband technology grants for the deployment 1 12 and sustainability of high=speed broadband access: 1 13 .................................................. $ 25,000,000 1 14 a. It is the intent of the general assembly that 1 15 funds appropriated under this subsection for the 1 16 deployment and sustainability of high=speed broadband 1 17 access be used to access any federal funds made 1 18 available. State and federal funds made available for 1 19 broadband deployment shall be used to promote 1 20 universal access to high=speed broadband services or 1 21 used by private providers to promote telehealth 1 22 according to federal requirements throughout the state 1 23 for the benefit of Iowans and for the sustainability 1 24 of such services. 1 25 b. (1) The utilities board created in section 1 26 474.1 and the economic development board created in 1 27 section 15.103 shall establish a joint governance 1 28 board consisting of the following members: 1 29 (a) Five voting members: 1 30 (i) One member representing counties. 1 31 (ii) One member representing cities. 1 32 (iii) One member representing the department of 1 33 education. 1 34 (iv) One member representing urban residential 1 35 users in the state. 1 36 (v) One member representing rural residential 1 37 users in the state. 1 38 (b) Four nonvoting, ex officio members 1 39 representing the general assembly: 1 40 (i) Two members appointed from the senate with one 1 41 member appointed by the majority leader of the senate 1 42 and one member appointed by the minority leader of the 1 43 senate. 1 44 (ii) Two members appointed from the house of 1 45 representatives with one member appointed by the 1 46 speaker of the house and one member appointed by the 1 47 minority leader of the house. 1 48 (2) Administrative support and planning costs 1 49 incurred for the governance board shall be provided by 1 50 the economic development board. Any necessary rules 2 1 shall be adopted by the economic development board on 2 2 behalf of the governance board. 2 3 (3) A quorum of the governance board shall be a 2 4 majority of the voting members. 2 5 c. The governance board established in paragraph 2 6 "b" shall do all of the following: 2 7 (1) Establish a comprehensive plan for the 2 8 deployment and sustainability of high=speed broadband 2 9 access in areas capable of timely implementation of 2 10 such access. The plan shall be consistent with 2 11 federal requirements established for federal funds 2 12 made available for the purposes of such projects that 2 13 may be considered by the governance board. 2 14 (2) Establish a competitive process for the 2 15 disbursement of funds made available for the 2 16 deployment and sustainability of high=speed broadband 2 17 services in the form of grants. The governance board 2 18 shall only consider applications from parties seeking 2 19 to use funds for projects that are sustainable. 2 20 (a) The board shall consider only applications 2 21 submitted by qualified private providers of high=speed 2 22 broadband services or by private providers to promote 2 23 telehealth. 2 24 (b) The board may award to any one qualified 2 25 provider a grant in an amount of up to twenty percent 2 26 of the total funds appropriated. 2 27 (c) The plan shall allow for grants to projects 2 28 that are financially feasible in areas of the state 2 29 that remain unserved or underserved consistent with 2 30 federal requirements. 2 31 (3) Provide minimum broadband capacity throughout 2 32 the area consistent with any applicable state and 2 33 federal law or guidelines. The governance board shall 2 34 ensure that the minimum broadband capacity meets any 2 35 federal requirements established with regard to the 2 36 federal funds made available in the form of grants. 2 37 (4) Demonstrate that any project undertaken and 2 38 funded by the governance board shall be economically 2 39 sustainable with no further government assistance 2 40 based upon expected revenue generation. 2 41 (5) Establish and maintain separate accounts for 2 42 the use of bond proceeds and nonbond proceeds.> 2 43 #2.
