     1  1    Amend the amendment, S=3328, to Senate File 478 as
     1  2 follows:
     1  3 #1.  Page 65, by inserting after line 40 the
     1  4 following:
     1  5                      <DIVISION    
     1  6                       MAGISTRATES
     1  7    Sec.    .  Section 602.6401, subsection 4, Code
     1  8 2009, is amended to read as follows:
     1  9    4.  By March of each year in which magistrates'
     1 10 terms expire, the state court administrator shall give
     1 11 notice to the clerks of the district court and to the
     1 12 chief judges of the judicial districts of the number
     1 13 of magistrates to which each county is entitled.  If
     1 14 the state court administrator does not give the notice
     1 15 as required in this subsection by March of each year
     1 16 in which magistrates' terms expire, the existing
     1 17 magistrate apportionment in effect shall remain in
     1 18 effect through the succeeding magistrates' terms, and
     1 19 any apportionment performed pursuant to subsection 2
     1 20 is void until such succeeding terms expire.
     1 21    Sec.    .  EFFECTIVE DATE == RETROACTIVE
     1 22 APPLICABILITY.  This division of this Act, being
     1 23 deemed of immediate importance, takes effect upon
     1 24 enactment and applies retroactively to January 1,
     1 25 2009, to void any apportionment for which notice was
     1 26 not given by March of 2009.>
