     1 40 LIQUID MANURE ON SNOW COVERED GROUND OR FROZEN GROUND

     1 42    1.  On or before February 15 of each year, the
     1 43 director of the department, or the department's
     1 44 designee, shall appear before and present a report to
     1 45 the standing committees of the senate and house of
     1 46 representatives having jurisdiction over agriculture
     1 47 and environmental protection.  The report shall
     1 48 include all instances in which persons have applied
     1 49 liquid manure originating from a manure storage
     1 50 structure, that is part of a confinement feeding
     2  1 operation, on snow covered ground or frozen ground
     2  2 because of an emergency as provided in section
     2  3 459.313A.  The report shall include an assessment of
     2  4 the application's impact on water quality, including
     2  5 the success of actions taken to prevent or remediate
     2  6 such impact.
     2  7    2.  This section is repealed on July 1, 2014.>

     2 11 MANURE CONTROL == WATER QUALITY.
     2 12    A dry bedded confinement feeding operation shall
     2 13 retain all dry bedded manure produced by the operation
     2 14 between periods of dry bedded manure application.  For
     2 15 purposes of this section, dry bedded manure may be
     2 16 retained by stockpiling as provided in this chapter.
     2 17 A dry bedded confinement feeding operation shall not
     2 18 discharge dry bedded manure directly into water of the
     2 19 state or into a tile line that discharges directly
     2 20 into water of the state.
     2 21    Sec.    .  NEW SECTION.  459B.306  STOCKPILING ==
     2 22 NPDES REQUIREMENTS == WATER QUALITY.
     2 23    A person stockpiling dry bedded manure shall comply
     2 24 with applicable requirements of the national pollutant
     2 25 discharge elimination system pursuant to the federal
     2 26 Water Pollution Control Act, 33 U.S.C. ch. 26, as
     2 27 amended, and 40 C.F.R. pts. 122 and 412.>
