     1  1    Amend House File 809, as amended, passed, and
     1  2 reprinted by the House, as follows:
     1  3 #1.  Page 33, by inserting after line 22 the
     1  4 following:
     1  5                      <DIVISION    
     1  6          INFORMATION TECHNOLOGY CONSOLIDATION
     1  7    Sec.    .  Section 8A.201, Code 2009, is amended by
     1  8 adding the following new subsection:
     1  9    NEW SUBSECTION.  3A.  "Infrastructure services"
     1 10 means server systems, including mainframe and other
     1 11 server operations, desktop support, electronic mail,
     1 12 printing, and printing procurement services.
     1 13    Sec.    .  Section 8A.201, subsection 4, Code 2009,
     1 14 is amended by striking the subsection and inserting in
     1 15 lieu thereof the following:
     1 16    4.  "Participating agency" means any state agency.
     1 17    Sec.    .  Section 8A.204, subsection 3, Code 2009,
     1 18 is amended by adding the following new paragraph:
     1 19    NEW PARAGRAPH.  h.  Oversee the providing of
     1 20 infrastructure services to participating agencies by
     1 21 the department pursuant to section 8A.208.  In
     1 22 addition, the board shall establish a waiver process
     1 23 as provided in section 8A.208.
     1 24    Sec.    .  NEW SECTION.  8A.208  INFRASTRUCTURE
     1 25 SERVICES.
     1 26    1.  The department shall be the sole provider of
     1 27 infrastructure services for participating agencies.
     1 28 The department may procure infrastructure services in
     1 29 the manner provided in section 8A.207.
     1 30    2.  The technology governance board shall oversee
     1 31 the services provided pursuant to this section.  In
     1 32 addition, the technology governance board shall adopt
     1 33 rules allowing for a participating agency to seek a
     1 34 waiver from the requirements of this section.  The
     1 35 rules shall provide that a waiver shall be granted
     1 36 only if the participating agency can show that it can
     1 37 obtain the particular infrastructure service more
     1 38 economically or that a waiver would be in the best
     1 39 interest of the state.>
