     1  1    Amend the amendment, S=3208, to Senate File 464, as
     1  2 follows:
     1  3 #1.  Page 2, line 27, by inserting after the figure
     1  4 <214A.2.> the following:  <This section only applies
     1  5 to the following counties:  Benton, Black Hawk,
     1  6 Buchanan, Delaware, Dubuque, Johnson, Jones, and
     1  7 Linn.>
     1  8 #2.  Page 3, by inserting after line 29, the
     1  9 following:
     1 10    <Sec.    .  BIODIESEL STUDY.  The department of
     1 11 agriculture and land stewardship, in cooperation with
     1 12 the petroleum marketers and convenience stores of
     1 13 Iowa, shall compile information regarding the
     1 14 implementation of this division of this Act and
     1 15 division III of this Act, including issues involving
     1 16 supplies of biodiesel fuel designated B=5 or higher,
     1 17 the use and demand of biodiesel fuel designated B=5 or
     1 18 higher, the degree to which infrastructure exists to
     1 19 support the distribution and dispensing of biodiesel
     1 20 fuel designated B=5 or higher, and problems associated
     1 21 with the use of biodiesel fuel designated B=5 or
     1 22 higher.  The department, in cooperation with the
     1 23 petroleum marketers and convenience stores of Iowa,
     1 24 shall report the information, findings, and
     1 25 recommendations to the general assembly not later than
     1 26 January 16, 2012.>
     1 27 #3.  Page 8, by inserting after line 38, the
     1 28 following:
     1 29    <Sec.    .  APPLICABILITY OF DIVISION.  This
     1 30 division of this Act only applies to the following
     1 31 counties:  Benton, Black Hawk, Buchanan, Delaware,
     1 32 Dubuque, Johnson, Jones, and Linn.  Sections 422.11N,
     1 33 422.11P, 422.33, and 452A.31, Code 2009, section 22 of
     1 34 this division of this Act, and 2006 Iowa Acts, chapter
     1 35 1142, section 49, subsection 5, as amended in this
     1 36 division of this Act, shall continue to apply to all
     1 37 other counties.  The department of agriculture and
     1 38 land stewardship and the department of revenue shall
     1 39 adopt all rules necessary to implement this division.>
