     1  6 is amended to read as follows:
     1  7    4.  "Foreign" means a locality outside of or nation
     1  8 other than the United States, Canada, or Mexico.>

     1 39 by adding the following new subsection:
     1 40    NEW SUBSECTION.  4A.  Of the moneys appropriated to
     1 41 the office and deposited in the fund, notwithstanding
     1 42 section 469.9, subsection 4, the director may allocate
     1 43 up to one million dollars annually to the department
     1 44 of economic development for the purpose of funding the
     1 45 research activities credit relating to innovative
     1 46 renewable energy generation components pursuant to
     1 47 section 15.335.>
     1 48 #10.  Page 19, by inserting after line 10 the
     1 49 following:
     1 50    <Sec.    .  Section 473.13A, Code 2009, is amended
     2  1 to read as follows:
     2  2    473.13A  ENERGY CONSERVATION MEASURES MANAGEMENT
     2  3 IMPROVEMENTS IDENTIFIED AND IMPLEMENTED.
     2  4    The state, state agencies, political subdivisions
     2  5 of the state, school districts, area education
     2  6 agencies, and community colleges shall identify and
     2  7 implement, through energy audits and engineering
     2  8 analyses, all energy conservation measures management
     2  9 improvements identified for which financing is made
     2 10 available facilitated by the department to office for
     2 11 the entity.  The energy conservation measure
     2 12 management improvement financings shall be supported
     2 13 through payments from energy savings.
     2 14    The department shall not require a school district,
     2 15 community college, area education agency, city, or
     2 16 county to perform an engineering analysis if the
     2 17 school district, community college, area education
     2 18 agency, city, or county demonstrates to the department
     2 19 that the facility which is the subject of the proposed
     2 20 engineering analysis at issue is unlikely to be in use
     2 21 or operation in six years by the governmental entity
     2 22 currently using or occupying the facility.>

     2 24 #12.  Title page, by striking lines 1 and 2 and
     2 25 inserting the following:  <An Act relating to energy
     2 26 efficiency and renewable energy, including allocating
