     1  1    Amend the amendment, S=3175, to Senate File 465, as
     1  2 follows:
     1  3 #1.  Page 2, line 45, by inserting after the word
     1  4 <e.> the following:  <(1)  The county treasurer, on
     1  5 behalf of the recorder, shall establish and maintain a
     1  6 county recorder's redaction fund into which all moneys
     1  7 collected pursuant to section 331.606B, subsection 7,
     1  8 shall be deposited.  Interest earned on moneys
     1  9 deposited in this fund shall be computed based on the
     1 10 average monthly balance in the fund and shall be
     1 11 credited to the county recorder's redaction fund.
     1 12    (2)  The local government redaction fund is
     1 13 established in the office of the treasurer of state
     1 14 under the control of the treasurer of state.  Moneys
     1 15 deposited into the fund are not subject to section
     1 16 8.33.  Notwithstanding section 12C.7, interest or
     1 17 earnings on moneys in the local government redaction
     1 18 fund shall be credited to the fund.  Moneys in the
     1 19 local government redaction fund are not subject to
     1 20 transfer, appropriation, or reversion to any other
     1 21 fund, or any other use except as provided in this
     1 22 subparagraph.  On a monthly basis, the county
     1 23 treasurer shall pay the fees deposited into the county
     1 24 recorder's redaction fund to the treasurer of state
     1 25 for deposit into the local government redaction fund.
     1 26 Moneys credited to the local government redaction fund
     1 27 are appropriated to the treasurer of state for the
     1 28 payment of claims approved by the governing board of
     1 29 the county land record information system.
     1 30 Expenditures from the fund shall be used for the
     1 31 purpose specified in paragraph "b", subparagraph (2),
     1 32 subparagraph division (d), and may be combined with
     1 33 expenditures made from the local government electronic
     1 34 transaction fund for that purpose.

     1 39 #3.  Page 3, by inserting after line 2 the
     1 40 following:
     1 41    <#   .  Page 7, by striking lines 5 through 9 and
     1 42 inserting the following:
     1 43    <Sec.    .  Section 331.606B, subsection 1,
     1 44 unnumbered paragraph 1, Code 2009, is amended to read
     1 45 as follows:
     1 46    Except as otherwise provided in subsection
     1 47 subsections 6 and 7, the county recorder shall refuse
     1 48 any document or instrument presented for recording
     1 49 that does not meet the following requirements:
     1 50    Sec.    .  Section 331.606B, Code 2009, is amended
     2  1 by adding the following new subsection:
     2  2    NEW SUBSECTION.  7.  a.  On or after July 1, 2009,
     2  3 a document or instrument that does not conform to the
     2  4 requirements of section 331.606A, subsection 2, shall
     2  5 not be accepted for recording except upon payment of
     2  6 an additional recording fee of one hundred dollars per
     2  7 document or instrument.  The requirement applies only
     2  8 to documents or instruments dated on or after July 1,
     2  9 2009, and does not apply to those documents or
     2 10 instruments specifically exempted under subsection 4.
     2 11    b.  Additional recording fees collected under
     2 12 paragraph "a" shall be deposited in the county
     2 13 recorder's redaction fund established in section
     2 14 331.604, subsection 3, paragraph "e".>>
