     1  1    Amend House File 2376 as follows:
     1  2 #1.  Page 1, before line 1 by inserting:
     1  3    <Sec. ___.  Section 331.304, subsection 3, paragraph
     1  4 a, Code 2009, is amended to read as follows:
     1  5    a.  A county building code shall not apply within
     1  6 the incorporated area of a city except at the option of
     1  7 the city, and shall not apply within a city's two=mile
     1  8 limit referred to in section 414.23, to the extent
     1  9 that the city has adopted a building code within the
     1 10 two=mile limit.
     1 11    Sec. ___.  Section 331.321, subsection 1, paragraph
     1 12 u, Code Supplement 2009, is amended by striking the
     1 13 paragraph.>
     1 14 #2.  Page 2, after line 22 by inserting:
     1 15    <Sec. ___.  Section 427B.2, subsection 2, Code
     1 16 Supplement 2009, is amended to read as follows:
     1 17    2.  The board of supervisors of a county which has
     1 18 not appointed a zoning commission may provide for a
     1 19 partial exemption from property taxation of the actual
     1 20 value added to industrial real estate as provided under
     1 21 section 427B.1 in the following areas:
     1 22    a.  Outside an area outside the incorporated limits
     1 23 of a city to which a city has extended its zoning
     1 24 ordinance pursuant to section 414.23 which complies
     1 25 with the city's zoning ordinance.
     1 26    b.  Outside the incorporated limits of a city which
     1 27 has adopted a zoning ordinance but which has not
     1 28 extended the ordinance to the area permitted under
     1 29 section 414.23 if the property would be within the area
     1 30 to which a city may extend a zoning ordinance pursuant
     1 31 to section 414.23.
     1 32    c.  Outside the incorporated limits of a city which
     1 33 has not adopted a zoning ordinance but which would be
     1 34 within the area to which a city may extend a zoning
     1 35 ordinance pursuant to section 414.23.
     1 36    Sec. ___.  Section 716.7, subsection 2, Code 2009,
     1 37 is amended by adding the following new paragraph:
     1 38    NEW PARAGRAPH.  f.  Entering upon or in property
     1 39 that is under consideration for condemnation by an
     1 40 acquiring agency, as defined in section 6B.1, but prior
     1 41 to the commencement of eminent domain proceedings under
     1 42 chapter 6A or 6B, without the express permission of
     1 43 the owner, lessee, or person in lawful possession.
     1 44    Sec. ___.  REPEAL.  Section 414.23, Code 2009, is
     1 45 repealed.>
     1 46 #3.  Title page line 1, after <Act> by inserting

     1 48 relating to trespassing and zoning and>
