     1  1    Amend the amendment, H=8045, to Senate File 2088,
     1  2 as amended, passed, and reprinted by the Senate, as
     1  3 follows:

     1  6    <Sec. ___.  Section 257.35, subsection 1, Code
     1  7 Supplement 2009, is amended to read as follows:
     1  8    1.  The For school budget years beginning prior to
     1  9 July 1, 2011, the department of management shall deduct
     1 10 the amounts calculated for special education support
     1 11 services, media services, area education agency teacher
     1 12 salary supplement district cost, area education agency
     1 13 professional development supplement district cost, and
     1 14 educational services for each school district from
     1 15 the state aid due to the district pursuant to this
     1 16 chapter and shall pay the amounts to the respective
     1 17 area education agencies on a monthly basis from
     1 18 September 15 through June 15 during each school year.
     1 19 The department of management shall notify each school
     1 20 district of the amount of state aid deducted for these
     1 21 purposes and the balance of state aid shall be paid
     1 22 to the district.  If a district does not qualify for
     1 23 state aid under this chapter in an amount sufficient to
     1 24 cover its amount due to the area education agency as
     1 25 calculated by the department of management, the school
     1 26 district shall pay the deficiency to the area education
     1 27 agency from other moneys received by the district, on a
     1 28 quarterly basis during each school year.
     1 29    Sec. ___.  NEW SECTION.  257.35A  Area education
     1 30 agencies ==  state funding redirected.
     1 31    1.  Notwithstanding any provision of this chapter
     1 32 to the  contrary, for school budget years beginning
     1 33 on or after July 1,  2011, the state aid funding for
     1 34 special education support  services, media services, and
     1 35 educational services, as  calculated by this chapter,
     1 36 shall be paid directly to the  applicable school
     1 37 district.
     1 38    2.  A school district may solicit bids from area
     1 39 education agencies and Iowa community colleges to
     1 40 provide special education services, media services,
     1 41 and  educational services, as those services are
     1 42 described in  chapter 273.  However, the school district
     1 43 soliciting bids  shall not receive funding for its costs
     1 44 that exceeds the  amount determined under subsection 1.
     1 45    3.  The department of education shall distribute
     1 46 the  appropriate amount of area education agency
     1 47 professional  development supplement and area education
     1 48 agency teacher  salary supplement funding to a school
     1 49 district if an area  education agency successfully bids
     1 50 to provide the services.
     2  1    Sec. ___.  Section 260C.14, Code Supplement 2009, is
     2  2 amended by adding the following new subsection:
     2  3    NEW SUBSECTION.  23.  To the extent authorized by
     2  4 section 273.9A, have the powers and duties with respect
     2  5 to community colleges, not otherwise provided in this
     2  6 chapter, which are prescribed for boards of directors
     2  7 of area education agencies by chapter 273.
     2  8    Sec. ___.  Section 273.9, subsection 1, Code 2009,
     2  9 is amended to read as follows:
     2 10    1.  School For school budget years beginning prior
     2 11 to July 1, 2011, school districts shall pay for
     2 12 the programs and services provided through the area
     2 13 education agency and shall include expenditures for the
     2 14 programs and services in their budgets, in accordance
     2 15 with this section.
     2 16    Sec. ___.  NEW SECTION.  273.9A  Funding from school
     2 17 districts  == state and local funds.
     2 18    Notwithstanding any provision of this chapter to
     2 19 the  contrary, for school budget years beginning on or
     2 20 after July 1,  2011, an area education agency or Iowa
     2 21 community college shall  receive state aid funding for
     2 22 providing special education  support services, media
     2 23 services, and educational services  from the applicable
     2 24 school district.  Area education agencies  and Iowa
     2 25 community colleges may submit bids for providing
     2 26 special  education support services, media services,
     2 27 and educational  services in a process to be determined
     2 28 by the department of  education by rule under chapter
     2 29 17A.>>
