1 1 Amend House File 97 as follows:
1 2 #1. Page 1, by striking lines 16 through 18 and
1 3 inserting:
1 4 <2. a. A motor vehicle operated on a highway shall
1 5 display lighted headlamps, as provided in section
1 6 321.415, or daytime running lamps whenever there is
1 7 moisture accumulating on the windshield due to misting,
1 8 light rain, or other weather conditions or whenever
1 9 the motor vehicle's windshield wipers are activated to
1 10 improve visibility.
1 11 b. For purposes of this subsection, "daytime
1 12 running lamps" means a pair of lamps on the front of
1 13 a motor vehicle which meet the standard for daytime
1 14 running lamps described in 49 C.F.R. { 571.108.>

1 17 #3. Page 1, after line 26 by inserting:
1 18 <Sec. ___. Section 321.415, subsection 1,
1 19 unnumbered paragraph 1, Code 2009, is amended to read
1 20 as follows:
1 21 Whenever a motor vehicle is being operated on
1 22 a roadway or shoulder during the times specified
1 23 in section 321.384, unless the motor vehicle is
1 24 displaying daytime running lamps as permitted under
1 25 section 321.384, subsection 2, the driver shall use
1 26 a distribution of light, or composite beam, directed
1 27 high enough and of sufficient intensity to reveal
1 28 persons and vehicles at a safe distance in advance of
1 29 the vehicle, subject to the following requirements and
1 30 limitations:>
1 31 #4. Title page, lines 1 and 2, by striking <on
1 32 a motor vehicle during any period of moisture
1 33 accumulation> and inserting <or daytime running
1 34 lamps on a motor vehicle during periods of moisture
1 35 accumulation or windshield wiper use>
