IOWA TELECOMMUNICATIONS AND TECHNOLOGY 2 25 COMMISSION 2 26 For broadband technology grants for the deployment 2 27 and sustainability of high=speed broadband access: 2 28 .................................................. $ 25,000,000 2 29 a. It is the intent of the general assembly that 2 30 funds appropriated under this subsection for the 2 31 deployment and sustainability of high=speed broadband 2 32 access be used to access any federal funds made 2 33 available. State and federal funds made available for 2 34 broadband deployment shall be used to promote 2 35 universal access to high=speed broadband services or 2 36 used by private providers to promote telehealth 2 37 according to federal requirements throughout the state 2 38 for the benefit of Iowans and for the sustainability 2 39 of such services. 2 40 b. (1) The utilities board created in section 2 41 474.1 and the economic development board created in 2 42 section 15.103 shall establish a joint governance 2 43 board consisting of the following members: 2 44 (a) Five voting members: 2 45 (i) One member representing counties. 2 46 (ii) One member representing cities. 2 47 (iii) One member representing the department of 2 48 education. 2 49 (iv) One member representing urban residential 2 50 users in the state. 3 1 (v) One member representing rural residential 3 2 users in the state. 3 3 (b) Four nonvoting, ex officio members 3 4 representing the general assembly: 3 5 (i) Two members appointed from the senate with one 3 6 member appointed by the majority leader of the senate 3 7 and one member appointed by the minority leader of the 3 8 senate. 3 9 (ii) Two members appointed from the house of 3 10 representatives with one member appointed by the 3 11 speaker of the house and one member appointed by the 3 12 minority leader of the house. 3 13 (2) Administrative support and planning costs 3 14 incurred for the governance board shall be provided by 3 15 the economic development board. Any necessary rules 3 16 shall be adopted by the economic development board on 3 17 behalf of the governance board. 3 18 (3) A quorum of the governance board shall be a 3 19 majority of the voting members. 3 20 c. The governance board established in paragraph 3 21 "b" shall do all of the following: 3 22 (1) Establish a comprehensive plan for the 3 23 deployment and sustainability of high=speed broadband 3 24 access in areas capable of timely implementation of 3 25 such access. The plan shall be consistent with 3 26 federal requirements established for federal funds 3 27 made available for the purposes of such projects that 3 28 may be considered by the governance board. 3 29 (2) Establish a competitive process for the 3 30 disbursement of funds made available for the 3 31 deployment and sustainability of high=speed broadband 3 32 services in the form of grants. The governance board 3 33 shall only consider applications from parties seeking 3 34 to use funds for projects that are sustainable. 3 35 (a) The board shall consider only applications 3 36 submitted by qualified private providers of high=speed 3 37 broadband services or by private providers to promote 3 38 telehealth. 3 39 (b) The board may award to any one qualified 3 40 provider a grant in an amount of up to twenty percent 3 41 of the total funds appropriated. 3 42 (c) The plan shall allow for grants to projects 3 43 that are financially feasible in areas of the state 3 44 that remain unserved or underserved consistent with 3 45 federal requirements. 3 46 (3) Provide minimum broadband capacity throughout 3 47 the area consistent with any applicable state and 3 48 federal law or guidelines. The governance board shall 3 49 ensure that the minimum broadband capacity meets any 3 50 federal requirements established with regard to the 4 1 federal funds made available in the form of grants. 4 2 (4) Demonstrate that any project undertaken and 4 3 funded by the governance board shall be economically 4 4 sustainable with no further government assistance 4 5 based upon expected revenue generation. 4 6 (5) Establish and maintain separate accounts for 4 7 the use of bond proceeds and nonbond proceeds.>> 4 8 #7.
