1 1 Amend the amendment, H=1704, to Senate File 304, as
1 2 passed by the Senate, as follows:
1 3 #1. Page 1, by inserting before line 5 the
1 4 following:
1 5 <Section 1. Section 403.19A, subsection 2, Code
1 6 2009, is amended to read as follows:
1 7 2. a. An eligible city may apply to the
1 8 department of economic development to be designated as
1 9 a pilot project city. An eligible city is a city that
1 10 contains meets one of the following requirements:
1 11 (1) Contains three or more census tracts and is
1 12 located in a county meeting one of the following
1 13 requirements:
1 14 (1) (a) A county that borders Nebraska.
1 15 (2) (b) A county that borders South Dakota.
1 16 (3) (c) A county that borders a state other than
1 17 Nebraska or South Dakota.
1 18 (2) Shares a boundary contiguous with an approved
1 19 pilot project city.
1 20 b. (1) The department of economic development
1 21 shall approve four eligible cities as pilot project
1 22 cities, one pursuant to paragraph "a", subparagraph
1 23 (1), subparagraph division (a), one pursuant to
1 24 paragraph "a", subparagraph (2) (1), subparagraph
1 25 division (b), and two pursuant to paragraph "a",
1 26 subparagraph (3) (1), subparagraph division (c). The
1 27 department shall approve additional eligible cities as
1 28 pilot project cities pursuant to paragraph "a",
1 29 subparagraph (2). If two eligible cities are approved
1 30 pursuant to paragraph "a", subparagraph (1), which are
1 31 located in the same county and the county has a
1 32 population of less than forty=five thousand, the two
1 33 approved eligible cities shall be considered one pilot
1 34 project city. If more than two cities meeting the
1 35 requirements of paragraph "a", subparagraph (3) (1),
1 36 subparagraph division (c), apply to be designated as a
1 37 pilot project city, the department of economic
1 38 development shall determine which two cities hold the
1 39 most potential to create new jobs or generate the
1 40 greatest capital within their areas. Applications
1 41 from eligible cities filed on or after October 1,
1 42 2006, shall not be considered.
1 43 (2) If a pilot project city does not enter into a
1 44 withholding agreement within one year of its approval
1 45 as a pilot project city, the city shall lose its
1 46 status as a pilot project city. If two pilot project
1 47 cities are located in the same county, the loss of
1 48 status by one pilot project city shall not cause the
1 49 second pilot project city in the county to lose its
1 50 status as a pilot project city. Upon such occurrence,
2 1 the department of economic development shall take
2 2 applications from other eligible cities to replace
2 3 that city. Another city shall be designated within
2 4 six months.>
