5 15 c. For the construction of the cabins, activity
5 16 building, picnic shelters, and other costs associated
5 17 with the opening of the Honey creek premier
5 18 destination park:

5 20 The department shall not obligate any funding under
5 21 this appropriation without approval from the
5 22 department of management. The department shall
5 23 provide quarterly updates to the Honey creek premier
5 24 destination park authority and the legislative
5 25 services agency on the obligation and spending of this
5 26 appropriation.
5 27 In light of this appropriation, the department
5 28 shall not request additional appropriations for
5 29 funding the construction of future additional
5 30 amenities at the Honey creek destination park beyond
5 31 the fiscal year ending June 30, 2009. In the event
5 32 that the chairperson of the authority delivers a
5 33 certificate to the governor, pursuant to section
5 34 463C.13, stating the amounts necessary to restore bond
5 35 reserve funds, it is the general assembly's intent
5 36 upon consideration of the governor's request to first
5 37 seek refunding from the department's budget.
5 38 d. c. For implementation of lake projects that
5 39 have established watershed improvement initiatives and
5 40 community support in accordance with the department's
5 41 annual lake restoration plan and report,
5 42 notwithstanding section 8.57, subsection 6, paragraph
5 43 "c":

5 46 (1) It is the intent of the general assembly that
5 47 the department of natural resources shall implement
5 48 the lake restoration annual report and plan submitted
5 49 to the joint appropriations subcommittee on
5 50 transportation, infrastructure, and capitals and the
6 1 legislative services agency on December 26, 2006,
6 2 pursuant to section 456A.33B. The lake restoration
6 3 projects that are recommended by the department to
6 4 receive funding for fiscal year 2007=2008 and that
6 5 satisfy the criteria in section 456A.33B, including
6 6 local commitment of funding for the projects, shall be
6 7 funded in the amounts provided in the report.
6 8 Of the amounts appropriated in this lettered
6 9 paragraph, at least the following amounts shall be
6 10 allocated as follows:
6 11 (a) For clear lake in Cerro Gordo county:

6 13 (b) For storm lake in Buena Vista county:
6 14 .................................................. $ 1,000,000
6 15 (c) For carter lake in Pottawattamie county:

6 17 (2) Of the moneys appropriated in this lettered
6 18 paragraph, $200,000 shall be used for the purposes of
6 19 supporting a low head dam public hazard improvement
6 20 program. The moneys shall be used to provide grants
6 21 to local communities, including counties and cities,
6 22 for projects approved by the department.
6 23 (a) The department shall award grants to dam
6 24 owners including counties, cities, state agencies,
6 25 cooperatives, and individuals, to support projects
6 26 approved by the department.
6 27 (b) The department shall require each dam owner
6 28 applying for a project grant to submit a project plan
6 29 for the expenditure of the moneys, and file a report
6 30 with the department regarding the project, as required
6 31 by the department.
6 32 (c) The funds can be used for signs, posts, and
6 33 related cabling, and the department shall only award
6 34 money on a matching basis, pursuant to the dam owner
6 35 contributing at least 20 cents for every 80 cents
6 36 awarded by the department, in order to finance the
6 37 project. For the remainder of the funds, including
6 38 any balance of money not awarded for signs, posts, and
6 39 related cabling, the department shall only award
6 40 moneys to a dam owner on a matching basis. A dam
6 41 owner shall contribute one dollar for each dollar
6 42 awarded by the department in order to finance a
6 43 project.

7 30 that the number of enplaned passengers at each
7 31 commercial air service airport bears to the total
7 32 number of enplaned passengers in the state during the
7 33 previous fiscal year, and ten percent of the funds
7 34 shall be allocated based on the percentage that the
7 35 air cargo tonnage at each commercial air service
7 36 airport bears to the total air cargo tonnage in the
7 37 state during the previous fiscal year. In order for a
7 38 commercial air service airport to receive funding
7 39 under this lettered paragraph, the airport shall be
7 40 required to submit applications for funding of
7 41 specific projects to the department for approval by
7 42 the state transportation commission.

8 2 Sec. . 2008 Iowa Acts, chapter 1179, sections
8 3 19 and 20, are amended to read as follows:
8 4 SEC. 19. TAX=EXEMPT STATUS == USE OF
8 5 APPROPRIATIONS. Payment of moneys from the
8 6 appropriations in this division of this Act shall be
8 7 made in a manner that does not adversely affect the
8 8 tax=exempt status of any outstanding bonds issued by
8 9 the tobacco settlement authority treasurer of state.
8 10 SEC. 20. REVERSION. Notwithstanding section 8.33,
8 11 moneys appropriated in this division of this Act for
8 12 the fiscal year beginning July 1, 2008, and ending
8 13 June 30, 2009, shall not revert at the close of the
8 14 fiscal year for which they are appropriated but shall
8 15 remain available for the purposes designated until the
8 16 close of the fiscal year that begins July 1, 2011
8 17 2012, or until the project for which the appropriation
8 18 was made is completed, whichever is earlier.
8 19 Sec. . EFFECTIVE DATE. This division of this
8 20 Act, being deemed of immediate importance, takes
8 21 effect upon enactment.>
