     1  1    Amend House File 765 as follows:
     1  2 #1.  Page 1, by inserting before line 16 the
     1  3 following:
     1  4    <Sec.    .  Section 15.102, subsection 7, Code
     1  5 2009, is amended to read as follows:
     1  6    7.  a.  "Targeted small business" means a small
     1  7 business which is fifty=one percent or more owned,
     1  8 operated, and actively managed by one or more women,
     1  9 minority persons, veterans, or persons with a
     1 10 disability provided the business meets all of the
     1 11 following requirements:
     1 12    (1)  Is located in this state.
     1 13    (2)  Is operated for profit.
     1 14    (3)  Has an annual gross income of less than four
     1 15 million dollars computed as an average of the three
     1 16 preceding fiscal years.
     1 17    b.  As used in this subsection:
     1 18    (1)  "Disability" means, with respect to an
     1 19 individual, a physical or mental impairment that
     1 20 substantially limits one or more of the major life
     1 21 activities of the individual, a record of physical or
     1 22 mental impairment that substantially limits one or
     1 23 more of the major life activities of the individual,
     1 24 or being regarded as an individual with a physical or
     1 25 mental impairment that substantially limits one or
     1 26 more of the major life activities of the individual.
     1 27 "Disability" does not include any of the following:
     1 28    (a)  Homosexuality or bisexuality.
     1 29    (b)  Transvestism, transsexualism, pedophilia,
     1 30 exhibitionism, voyeurism, gender identity disorders
     1 31 not resulting from physical impairments, or other
     1 32 sexual behavior disorders.
     1 33    (c)  Compulsive gambling, kleptomania, or
     1 34 pyromania.
     1 35    (d)  Psychoactive substance abuse disorders
     1 36 resulting from current illegal use of drugs.
     1 37    (2)  "Major life activity" includes functions such
     1 38 as caring for one's self, performing manual tasks,
     1 39 walking, seeing, hearing, speaking, breathing,
     1 40 learning, or working.
     1 41    (3)  "Minority person" means an individual who is a
     1 42 Black, Latino, Asian or Pacific Islander, American
     1 43 Indian, or Alaskan native American.
     1 44    (4)  "Veteran" has the same meaning as defined in
     1 45 section 35.1.>
