1 5 2009, is amended to read as follows:
1 6 5. A charter school shall provide instruction for
1 7 at least the number of days hours required by section
1 8 279.10, subsection 1, or shall provide at least the
1 9 equivalent number of total hours.>

1 11 inserting the following: <section 279.10, subsection
1 12 1, unless the school district maintains a year around
1 13 school calendar. However, this section does not apply
1 14 to a school district that has received approval from

1 41 guardian, or legal or actual custodian of a child who
1 42 is of compulsory attendance age, shall cause the child
1 43 to attend some public school, an accredited nonpublic
1 44 school, or competent private instruction in accordance
1 45 with the provisions of chapter 299A, during a school
1 46 year, as defined under section 279.10. The board of
1 47 directors of a public school district or the governing
1 48 body of an accredited nonpublic school shall set the
1 49 number of days hours of required attendance for the
1 50 schools under its control.
