     1  1    Amend Senate File 2132, as amended, passed, and
     1  2 reprinted by the Senate, as follows:
     1  3 #1.  Page 1, by striking lines 3 through 7 and
     1  4 inserting the following:
     1  5    <1.  Seized property which is no longer required as
     1  6 evidence or for use in an investigation shall be
     1  7 returned to the owner, provided that the person's
     1  8 possession of the property is not prohibited by law
     1  9 and there is no forfeiture claim filed on behalf of
     1 10 the state if the property is no longer required as
     1 11 evidence or the property has been photographed and the
     1 12 photograph will be used as evidence in lieu of the
     1 13 property, if the property is no longer required for
     1 14 use in an investigation, if the owner's possession is
     1 15 not prohibited by law, and if a forfeiture claim has
     1 16 not been filed on behalf of the state.>

     1 19 #3.  Page 1, line 21, by inserting before the word

     1 21 #4.  Page 2, line 22, by inserting before the word

     1 23 #5.  Page 2, line 28, by inserting after the word
     1 24 <firearms> the following:  <and ammunition, if not
     1 25 forfeited pursuant to chapter 809A, shall be disposed
     1 26 of by the department of public safety or the
     1 27 department of natural resources pursuant to section
     1 28 809.21.>
     1 29 #6.  Page 2, line 29, by inserting before the word
     1 30 <value> the following:  <aggregate fair market>.
     1 31 #7.  By striking page 2, line 33, through page 3,
     1 32 line 1, and inserting the following:
     1 33    <(3)  Notwithstanding subparagraph (2), firearms or
     1 34 ammunition with an aggregate fair market value equal
     1 35 to or less than five hundred dollars shall be
     1 36 deposited with the department of public safety.  The
     1 37 firearms or ammunition may be held by the department
     1 38 of public safety and be used for law enforcement,
     1 39 testing, or comparisons by the criminalistics
     1 40 laboratory, or may be destroyed or disposed of by the
     1 41 department of public safety in accordance with section
     1 42 809.21.>
