     1  2 reprinted by the House, as follows:
     1  3 #1.  Page 62, by inserting after line 19 the
     1  4 following:

     1  6              SCHOOL START DATE PROVISIONS
     1  7    Sec.    .  Section 257.17, Code 2007, is amended to
     1  8 read as follows:
     1  9    257.17  AID REDUCTION FOR EARLY SCHOOL STARTS.
     1 10    State aid payments made pursuant to section 257.16
     1 11 for a fiscal year shall be reduced by one
     1 12 one=hundred=eightieth for each day of that fiscal year
     1 13 for which the school district begins school before the
     1 14 earliest starting date specified in section 279.10,
     1 15 subsection 1.  However, this section does not apply to
     1 16 a school district that has received approval for a
     1 17 pilot program for an innovative school year from the
     1 18 director of the department of education under section
     1 19 279.10, subsection 4, to commence classes for
     1 20 regularly established elementary and secondary schools
     1 21 in advance of the starting date established in section
     1 22 279.10, subsection 1 3.
     1 23    Sec.    .  Section 279.10, subsection 1, Code 2007,
     1 24 is amended to read as follows:
     1 25    1.  The school year shall begin on the first day of
     1 26 July and each regularly established elementary and
     1 27 secondary school shall begin no sooner than a day
     1 28 during the calendar week in which the first day of
     1 29 September falls August 25 but no later than the first
     1 30 Monday in December unless the school district has
     1 31 received approval from the department of education for
     1 32 a pilot program in accordance with subsection 3.
     1 33 However, if the first day of September falls on a
     1 34 Sunday, school may begin on a day during the calendar
     1 35 week which immediately precedes the first day of
     1 36 September.  School shall continue for at least one
     1 37 hundred eighty days, except as provided in subsection
     1 38 3, and may be maintained during the entire calendar
     1 39 year.  However, if the board of directors of a
     1 40 district extends the school calendar because inclement
     1 41 weather caused the district to temporarily close
     1 42 school during the regular school calendar, the
     1 43 district may excuse a graduating senior who has met
     1 44 district or school requirements for graduation from
     1 45 attendance during the extended school calendar.  A
     1 46 school corporation may begin employment of personnel
     1 47 for in=service training and development purposes
     1 48 before the date to begin elementary and secondary
     1 49 school.
     1 50    Sec.    .  Section 279.10, subsection 2, Code 2007,
     2  1 is amended to read as follows:
     2  2    2.  The board of directors shall hold a public
     2  3 hearing on any proposal request made pursuant to
     2  4 subsection 3 prior to submitting it to the department
     2  5 of education for approval.
     2  6    Sec.    .  Section 279.10, subsection 4, Code 2007,
     2  7 is amended by striking the subsection.
     2  8    Sec.    .  EFFECTIVE DATES.  The section of this
     2  9 division of this Act that amends section 279.10,
     2 10 subsection 2, takes effect upon enactment and the
     2 11 sections of this division of this Act that amend
     2 12 section 257.17 and section 279.10, subsections 1 and
     2 13 4, take effect July 1, 2009, and are applicable for
     2 14 school years beginning on or after that date.>
