1 2 #1. By striking page 1, line 1, through page 2,

1 6 and inserting in lieu thereof the following:
1 7 26. Adopt rules that establish as the statewide
1 8 core curriculum guidelines for learning, teaching, and
1 9 assessment in English language arts, mathematics,
1 10 science, and technology and engineering for
1 11 prekindergarten through grade twelve the curriculum
1 12 frameworks adopted by the Massachusetts board of
1 13 education, updated as necessary.
1 14 Sec. . Section 256.7, subsection 28, Code
1 15 Supplement 2007, is amended by striking the
1 16 subsection.>

1 26 read as follows:
1 27 280.3 DUTIES OF BOARD EDUCATIONAL PROGRAM ==
1 28 ATTENDANCE CENTER REQUIREMENTS.
1 29 1. The board of directors of each public school
1 30 district and the authorities in charge of each
1 31 nonpublic school shall prescribe the minimum
1 32 educational program and an attendance policy which
1 33 shall require each child to attend school for at least
1 34 one hundred forty=eight days, to be met by attendance
1 35 for at least thirty=seven days each school quarter,
1 36 for the schools under their jurisdictions.
1 37 2. The minimum educational program shall be the
1 38 curriculum set forth in subsection 3 of this section
1 39 and section 256.11, except as otherwise provided by
1 40 law. The board of directors of a public school
1 41 district shall not allow discrimination in any
1 42 educational program on the basis of race, color,
1 43 creed, sex, marital status or place of national
1 44 origin.
1 45 3. The board of directors of each public school
1 46 district and the authorities in charge of each
1 47 nonpublic school shall adopt by July 1, 2010, the
1 48 statewide core curriculum guidelines established for
1 49 prekindergarten through grade twelve by the state
1 50 board pursuant to section 256.7, subsection 26.
2 1 4. A nonpublic school which is unable to meet the
2 2 minimum educational program may request an exemption
2 3 from the state board of education. The authorities in
2 4 charge of the nonpublic school shall file with the
2 5 director of the department of education the names and
2 6 locations of all schools desiring to be exempted and
2 7 the names, ages, and post office addresses of all
2 8 pupils of compulsory school age who are enrolled. The
2 9 director, subject to the approval of the state board,
2 10 may exempt the nonpublic school from compliance with
2 11 the minimum educational program for two school years.
2 12 When the exemption has once been granted, renewal of
2 13 the exemption for each succeeding school year may be
2 14 conditioned by the director, with the approval of the
2 15 board, upon proof of achievement in the basic skills
2 16 of arithmetic, the communicative arts of reading,
2 17 writing, grammar, and spelling, and an understanding
2 18 of United States history, history of Iowa, and the
2 19 principles of American government, of the pupils of
2 20 compulsory school age exempted in the preceding year.
2 21 Proof of achievement shall be determined on the basis
2 22 of tests or other means of evaluation prescribed by
2 23 the director of the department of education with the
2 24 approval of the state board of education. The testing
2 25 or evaluation, if required, shall be accomplished
2 26 prior to submission of the request for renewal of the
2 27 exemption. Renewal requests shall be filed with the
2 28 director by April 15 of the school year preceding the
2 29 school year for which the applicants desire exemption.
2 30 This section shall not apply to schools eligible for
2 31 exemption under section 299.24.
2 32 5. The board of directors of each public school
2 33 district and the authorities in charge of each
2 34 nonpublic school shall establish and maintain
2 35 attendance centers based upon the needs of the school
2 36 age pupils enrolled in the school district or
2 37 nonpublic school. Public school kindergarten programs
2 38 shall and public and nonpublic school prekindergarten
2 39 programs may be provided. In addition, the board of
2 40 directors or governing authority may include in the
2 41 educational program of any school such additional
2 42 courses, subjects, or activities which it deems fit
2 43 the needs of the pupils.>
