1 5 RETIREMENT FOR SENIOR JUDGES
1 6 Sec. . Section 602.9202, Code 2007, is amended
1 7 by adding the following new subsection:
1 8 NEW SUBSECTION. 3A. "Senior judge retirement age"
1 9 means seventy=eight years of age or, if the senior
1 10 judge is reappointed as a senior judge for an
1 11 additional two=year term upon attaining seventy=eight
1 12 years of age pursuant to section 602.9203, eighty
1 13 years of age.
1 14 Sec. . Section 602.9203, subsection 5, Code
1 15 2007, is amended to read as follows:
1 16 5. a. A senior judge may be reappointed to
1 17 additional two=year terms, at the discretion of the
1 18 supreme court, if the judicial officer meets the
1 19 requirements of subsection 2.
1 20 b. A senior judge may be reappointed to an
1 21 additional two=year term upon attaining seventy=eight
1 22 years of age, at the discretion of the supreme court,
1 23 if the judicial officer meets the requirements of
1 24 subsection 2.
1 25 Sec. . Section 602.9204, subsection 1, Code
1 26 2007, is amended to read as follows:
1 27 1. A judge who retires on or after July 1, 1994,
1 28 and who is appointed a senior judge under section
1 29 602.9203 shall be paid a salary as determined by the
1 30 general assembly. A senior judge or retired senior
1 31 judge shall be paid an annuity under the judicial
1 32 retirement system in the manner provided in section
1 33 602.9109, but computed under this section in lieu of
1 34 section 602.9107, as follows: The annuity paid to a
1 35 senior judge or retired senior judge shall be an
1 36 amount equal to the applicable percentage multiplier
1 37 of the basic senior judge salary, multiplied by the
1 38 judge's years of service prior to retirement as a
1 39 judge of one or more of the courts included under this
1 40 article, for which contributions were made to the
1 41 system, except the annuity of the senior judge or
1 42 retired senior judge shall not exceed an amount equal
1 43 to the applicable specified percentage of the basic
1 44 senior judge salary used in calculating the annuity.
1 45 However, following the twelve=month period during
1 46 which the senior judge or retired senior judge attains
1 47 seventy=eight years of senior judge retirement age,
1 48 the annuity paid to the person shall be an amount
1 49 equal to the applicable percentage multiplier of the
1 50 basic senior judge salary cap, multiplied by the
2 1 judge's years of service prior to retirement as a
2 2 judge of one or more of the courts included under this
2 3 article, for which contributions were made to the
2 4 system, except that the annuity shall not exceed an
2 5 amount equal to the applicable specified percentage of
2 6 the basic senior judge salary cap. A senior judge or
2 7 retired senior judge shall not receive benefits
2 8 calculated using a basic senior judge salary
2 9 established after the twelve=month period in which the
2 10 senior judge or retired senior judge attains
2 11 seventy=eight years of senior judge retirement age.
2 12 The state shall provide, regardless of age, to an
2 13 active senior judge or a senior judge with six years
2 14 of service as a senior judge and to the judge's
2 15 spouse, and pay for medical insurance until the judge
2 16 attains the senior judge retirement age of
2 17 seventy=eight years.
2 18 Sec. . Section 602.9204, subsection 2,
2 19 paragraphs d and e, Code 2007, is amended to read as
2 20 follows:
2 21 d. "Basic senior judge salary cap" means the basic
2 22 senior judge salary, at the end of the twelve=month
2 23 period during which the senior judge or retired senior
2 24 judge attained seventy=eight years of senior judge
2 25 retirement age, of the office in which the person last
2 26 served as a judge before retirement as a judge or
2 27 senior judge.
2 28 e. "Escalator" means the difference between the
2 29 current basic salary, as of the time each payment is
2 30 made up to and including the twelve=month period
2 31 during which the senior judge or retired senior judge
2 32 attains seventy=eight years of senior judge retirement
2 33 age, of the office in which the senior judge last
2 34 served as a judge before retirement as a judge or
2 35 senior judge, and the basic annual salary which the
2 36 judge is receiving at the time the judge becomes
2 37 separated from full=time service as a judge of one or
2 38 more of the courts included in this article, as would
2 39 be used in computing an annuity pursuant to section
2 40 602.9107 without service as a senior judge.
2 41 Sec. . Section 602.9207, subsection 1, Code
2 42 2007, is amended to read as follows:
2 43 1. A senior judge shall cease to be a senior judge
2 44 upon completion of the twelve=month period during
2 45 which the judge attains seventy=eight years of senior
2 46 judge retirement age. The clerk of the supreme court
2 47 shall make a notation of the retirement of a senior
2 48 judge in the roster of senior judges, at which time
2 49 the senior judge shall become a retired senior judge.
2 50 Sec. . Section 602.9208, subsection 1, Code
3 1 2007, is amended to read as follows:
3 2 1. A senior judge, at any time prior to the end of
3 3 the twelve=month period during which the judge attains
3 4 seventy=eight years of senior judge retirement age,
3 5 may submit to the clerk of the supreme court a written
3 6 request that the judge's name be stricken from the
3 7 roster of senior judges. Upon the receipt of the
3 8 request the clerk shall strike the name of the person
3 9 from the roster of senior judges, at which time the
3 10 person shall cease to be a senior judge. A person who
3 11 relinquishes a senior judgeship as provided in this
3 12 subsection may be assigned to temporary judicial
3 13 duties as provided in section 602.1612.>
