1 25 or discovery in any civil proceeding, unless such
1 26 confidentiality is waived in writing by the livestock
1 27 producer. In addition, the university or an employee
1 28 or agent of the university shall release no other
1 29 information submitted by or gathered from or deduced
1 30 from a livestock producer or livestock operation
1 31 pursuant to a livestock odor mitigation evaluation
1 32 under section 266.49 or section 459.303, subsection 3,
1 33 unless such information is used in a research project,
1 34 which in turn shall not occur without the written
1 35 consent of the livestock producer. Any information
1 36 provided by, gathered from, or deduced from a
1 37 livestock producer or livestock operation in
1 38 connection with a research project or odor mitigation
1 39 evaluation that is in the possession of the livestock
1 40 producer or livestock operation shall not be subject
1 41 to subpoena or discovery in any civil action against
1 42 the producer.>

2 7 PROGRAM FOR LIVESTOCK MITIGATION EFFORTS.
2 8 1. a. Iowa state university, in cooperation with
2 9 the department of agriculture and land stewardship and
2 10 the department of natural resources, shall establish a
2 11 cost=share program for the livestock odor mitigation
2 12 research efforts as established in sections 266.43
2 13 through 266.45 that maximizes participation in the
2 14 livestock mitigation research efforts so as to
2 15 accomplish the purposes in section 266.42, subsection
2 16 1.
2 17 b. The cost=share program shall allow for monetary
2 18 contributions from livestock producers and other
2 19 persons with an interest in livestock production. In
2 20 addition, a livestock producer participating in a
2 21 livestock odor mitigation research effort as provided
2 22 in sections 266.43 through 266.45 shall provide
2 23 in=kind contributions to participate in a research
2 24 effort which may include but are not limited to
2 25 furnishing the livestock producer's own labor,
2 26 construction equipment, electricity and other utility
2 27 costs, insurance, real property tax payments, and
2 28 basic construction materials that may be reused or
2 29 continued to be used by the livestock producer after
2 30 the completion of the research effort.
2 31 2. This section does not apply to a livestock
2 32 producer who is required to contribute one hundred
2 33 percent of the total costs of conducting a research
2 34 project.>
