     1  1    Amend Senate File 2377, as passed by the Senate, as
     1  2 follows:
     1  3 #1.  Page 1, by inserting after line 17 the
     1  4 following:
     1  5    <Sec.    .  Section 459.312, subsection 4A, as
     1  6 enacted in 2006 Iowa Acts, Senate File 2076, section
     1  7 1, is amended to read as follows:
     1  8    4A.  The department shall provide for the receipt
     1  9 and processing of manure management plans, including
     1 10 updates to manure management plans, in an electronic
     1 11 format pursuant to section 459.302, not later than
     1 12 July 1, 2008 2009.  After that time, a person required
     1 13 to submit a manure management plan under this section
     1 14 may shall submit the manure management plan to the
     1 15 department and to the county board of supervisors in
     1 16 an electronic format.>
     1 17 #2.  Page 2, line 12, by inserting after the word
     1 18 <met.> the following:  <However, the department may
     1 19 send a letter of concern by certified mail to the
     1 20 owner of the confinement feeding operation that
     1 21 explicitly states the department's concern that a
     1 22 condition on the site where the confinement feeding
     1 23 operation is or may be constructed, if not addressed,
     1 24 may result in the pollution of the waters of the
     1 25 state.  The department's letter shall provide the
     1 26 reasons for its concern and a possible remedy to the
     1 27 condition which could be implemented by the owner.
     1 28 The letter shall also inform the owner of likely
     1 29 administrative or judicial action if the condition
     1 30 exists, is not remedied, and results in the pollution
     1 31 of the waters of the state when the confinement
     1 32 feeding operation commences operations.>
     1 33 #3.  Page 3, line 5, by inserting after the word
