     1  1    Amend the amendment, S=5166, to House File 2351, as
     1  2 amended, passed, and reprinted by the House, as
     1  3 follows:
     1  4 #1.  By striking page 2, line 22, through page 3,
     1  5 line 1, and inserting the following:
     1  6    <<(1)  An acquiring agency considering the use of
     1  7 eminent domain authority to acquire property as part
     1  8 of a project to construct a lake shall conduct a
     1  9 review of alternatives to such lake development before
     1 10 making a determination that such lake development is
     1 11 reasonable and necessary.  Notwithstanding section
     1 12 6B.56, if property is acquired by condemnation as part
     1 13 of a project to construct a lake, the prior owner of
     1 14 that property, or the prior owner's heirs or assigns,
     1 15 shall have first right to purchase the property at a
     1 16 price equal to the fair market value of the property
     1 17 at the time it was acquired by the acquiring agency
     1 18 from the prior owner if such property is offered for
     1 19 sale by the acquiring agency within ten years after
     1 20 acquisition of the property by the acquiring agency.>>
