     1  1    Amend Senate File 2219, as passed by the Senate, as
     1  2 follows:
     1  3 #1.  Page 1, line 4, by inserting after the word
     1  4 <trafficking> the following:  <, to include curricula
     1  5 on cultural sensitivity and the means to deal
     1  6 effectively and appropriately with trafficking
     1  7 victims.  Such training shall encourage law
     1  8 enforcement personnel to communicate in the language
     1  9 of the trafficking victims>.
     1 10 #2.  Page 1, by inserting after line 14 the
     1 11 following:
     1 12    <   .  "Debt bondage" means the status or condition
     1 13 of a debtor arising from a pledge of the debtor's
     1 14 personal services or a person under the control of a
     1 15 debtor's personal services as a security for debt if
     1 16 the reasonable value of such services is not applied
     1 17 toward the liquidation of the debt or the length and
     1 18 nature of those services are not respectively limited
     1 19 and defined.>
     1 20 #3.  Page 1, by inserting after line 28 the
     1 21 following:
     1 22    <3.  "Human trafficking" means participating in a
     1 23 venture to recruit, harbor, transport, supply
     1 24 provisions, or obtain a person for any of the
     1 25 following purposes:
     1 26    a.  Forced labor or service that results in
     1 27 involuntary servitude, peonage, debt bondage, or
     1 28 slavery.
     1 29    b.  Commercial sexual activity through the use of
     1 30 force, fraud, or coercion, except that if the
     1 31 trafficked person is under the age of eighteen, the
     1 32 commercial sexual activity need not involve force,
     1 33 fraud, or coercion.>

     1 35 following:
     1 36    <   .  "Involuntary servitude" means a condition of
     1 37 servitude induced by means of any scheme, plan, or
     1 38 pattern intended to cause a person to believe that if
     1 39 the person did not enter into or continue in such
     1 40 condition, that person or another person would suffer
     1 41 serious harm or physical restraint or the threatened
     1 42 abuse of legal process.>

     2 11    1.  A person who knowingly engages in human
     2 12 trafficking is guilty of a class "D" felony, except
     2 13 that if the victim is under the age of eighteen, the
     2 14 person is guilty of a class "C" felony.
     2 15    2.  A person who knowingly engages in human
     2 16 trafficking by causing or threatening to cause serious
     2 17 physical injury to another person is guilty of a class
     2 18 "C" felony, except that if the victim is under the age
     2 19 of eighteen, the person is guilty of a class "B"
     2 20 felony.
     2 21    3.  A person who knowingly engages in human
     2 22 trafficking by physically restraining or threatening
     2 23 to physically restrain another person is guilty of a
     2 24 class "D" felony, except that if the victim is under
     2 25 the age of eighteen, the person is guilty of a class
     2 26 "C" felony.
     2 27    4.  A person who knowingly engages in human
     2 28 trafficking by soliciting services or benefiting from
     2 29 the services of a victim is guilty of a class "D"
     2 30 felony, except that if the victim is under the age of
     2 31 eighteen, the person is guilty of a class "C" felony.
     2 32    5.  A person who knowingly engages in human
     2 33 trafficking by abusing or threatening to abuse the law
     2 34 or legal process is guilty of a class "D" felony,
     2 35 except that if the victim is under the age of
     2 36 eighteen, the person is guilty of a class "C" felony.
     2 37    6.  A person who knowingly engages in human
     2 38 trafficking by knowingly destroying, concealing,
     2 39 removing, confiscating, or possessing any actual or
     2 40 purported passport or other immigration document, or
     2 41 any other actual or purported government
     2 42 identification document of a victim is guilty of a
     2 43 class "D" felony, except that if that other person is
     2 44 under the age of eighteen, the person is guilty of a
     2 45 class "C" felony.
     2 46    7.  A person who benefits financially or by
     2 47 receiving anything of value from knowing participation
     2 48 in human trafficking is guilty of a class "D" felony,
     2 49 except that if the victim is under the age of
     2 50 eighteen, the person is guilty of a class "C" felony.

     3  3 #12.  Page 4, line 19, by inserting after the word

     3 36    <Sec.    .  HUMAN TRAFFICKING STUDY.  The
     3 37 legislative council is requested to authorize a study
     3 38 for the 2006 legislative interim on human trafficking.
     3 39 The study recommendations and findings shall include
     3 40 but are not limited to identifying the needs of human
     3 41 trafficking victims and law enforcement and any other
     3 42 agencies that serve victims of human trafficking.  The
     3 43 study report, including findings and recommendations,
     3 44 shall be submitted to the general assembly for
     3 45 consideration during the 2007 legislative session.
     3 46 The study shall be conducted by a study committee
     3 47 consisting of up to nine members of the general
     3 48 assembly.  A chairperson or co=chairpersons shall be
     3 49 designated by the legislative council.>
