     1  1    Amend the amendment, S=5118, to House File 2351, as
     1  2 amended passed, and reprinted by the House, as
     1  3 follows:
     1  4 #1.  By striking page 2, line 27, through page 3,
     1  5 line 6, and inserting the following:
     1  6    <<(1)  An acquiring agency considering the use of
     1  7 eminent domain authority to acquire property as part
     1  8 of a project to construct a lake shall conduct a
     1  9 review of prudent and feasible alternatives to such
     1 10 lake development prior to a determination that such
     1 11 lake development is reasonable and necessary.  If
     1 12 property is acquired by condemnation as part of a
     1 13 project to construct a lake, such property, during the
     1 14 useful life of the lake, shall not be transferred by
     1 15 the acquiring agency to a private party other than the
     1 16 prior owner from whom the property was acquired or a
     1 17 successor in interest to the prior owner.>>
